Cape Canaveral Special Magistrate Extends Compliance Deadlines for Local Property Owner
- Meeting Overview:
In a recent meeting of the Cape Canaveral Special Magistrate, the focus was on the compliance issues faced by a local property owner who had failed to obtain necessary permits for construction and alterations on their property. The Special Magistrate granted an extension for obtaining permits and finding an engineer to certify the work, emphasizing the need for compliance with city codes and building regulations.
The key issue discussed involved a property owner who had constructed alterations to their property, including a patio, staircase, deck, and garage enclosure, without the required permits and inspections as mandated by the city code and Florida Building Code. The Special Magistrate found that there were multiple violations, including the lack of a permit and inspections, and ordered the respondent to submit a survey and apply for a construction permit for the patio by June 25, 2024. In addition, the property owner was instructed to arrange for a final inspection of the work within the time permitted by the new permit to bring the property into compliance.
Furthermore, if the property is non-homestead, it could face foreclosure three months after the filing of the lien.
During the compliance hearing for the same property, it was noted that no permits had been applied for since the last hearing, and the property owner was present to discuss the difficulties in finding an engineer to assist with the process. The city expressed its willingness to work with the property owner, particularly regarding the doors which did not require an engineer.
The Special Magistrate urged the property owner to expand their search for an engineer and divided the compliance tasks into two parts, providing 60 additional days for all tasks except those related to the doors. For the doors, a 14-day deadline was set to submit the permits. The Special Magistrate issued a second amended order extending these deadlines and refrained from imposing any fines at the meeting while cautioning that future leniency might not be granted if compliance was not met.
