Gardner City Council Faces Multiple Open Meeting Law Complaints Over July 1st Meeting
- Meeting Overview:
The Gardner City Council convened on July 31st to address a series of open meeting law complaints, primarily focusing on the July 1st meeting concerning the proposed sale of the Gamma property to Bay State Racing LLC.
The most significant issue discussed was an open meeting law complaint filed by Paul Deo regarding the handling of the July 1st City Council meeting. The complaint alleged that Council President Elizabeth J. Kazinskas failed to move the meeting to Perry Auditorium, despite being notified of a large expected turnout. As a result, only 65 people were allowed in the council chambers, while others were directed to Perry Auditorium, where the audio-visual setup was reportedly inadequate.
In response to the complaint, a motion was made and seconded to authorize the Law Department to respond on behalf of the city council with the proposed response provided in the council packet. During the discussion, one councilor read the complaint aloud, emphasizing the grievance that the meeting’s venue was not changed to accommodate all attendees, thus allegedly dividing opposition to the racetrack proposal.
The councilor who read the complaint argued that there was no deliberate attempt to divide the opposition and highlighted positive feedback received about the meeting’s setup. The councilor stated, “This seems like a difference of opinions and a difference of opinions is not a violation of the open meeting law.”
Following this, the council addressed twelve additional identical complaints filed on behalf of various individuals by Paul Deo. Each complaint mirrored the initial one, focusing on the same July 1st meeting. For each complaint, motions were made and seconded to authorize the Law Department to respond with the proposed responses detailed in the city council packet.
One councilor expressed frustration over the repetitive nature of the complaints and criticized the complainant for allegedly misusing the open meeting law for personal grievances. The councilor urged others to conduct their own research before submitting complaints and not to be swayed by one individual’s perspective.
As the meeting progressed, the council continued to approve responses to each complaint without significant further discussion. A final motion to adjourn was made and seconded, concluding the special meeting.
