This suggestion was echoed by members of the Newbury commission, who emphasized the importance of an erosion control barrier along the no-disturb zone.
During the discussion, Mick sought clarification on the work within the buffer zones and the status of the existing landscape wall, confirming that the wall was a feature rather than a retaining structure. The possibility of the wetland being classified as a vernal pool was briefly considered. The commission stressed the need for compliance with Newbury’s regulations, even though the work was primarily on the Rowley side.
Mary proposed specific conditions, including a pre-construction meeting and the establishment of an erosion control barrier. The motion to issue a negative finding for the RDA, with these conditions, was made and passed unanimously. This decision highlighted the commission’s careful approach to ensuring environmental protection while facilitating property improvements.
Following the 27 Coleman Road discussion, the commission moved on to the RDA for a property on Grove Street. The project involved minor expansion of a driveway and walkway. The existing driveway, described as “binous concrete” and in poor condition, required resurfacing, and the expansion areas were clearly delineated in the plans presented. A concern was raised regarding the accuracy of the wetland boundary, which had been determined based on observable features rather than a site survey.
Further inquiry was made into the total land disturbance, which could potentially trigger the commission’s stormwater bylaw. The applicant was unable to provide an exact figure due to ongoing design work on the septic system. The commission emphasized the importance of not stockpiling construction spoils within the 100-foot buffer zone and recommended erosion control measures. Following a examination, the commission decided to proceed with a Negative Determination of Applicability, with conditions including a pre-construction meeting and ensuring no spoils remained within the buffer zone.
The meeting also addressed an enforcement order for a property on Oldo Road, where a Notice of Intent had been submitted to address previously installed features and close out an expired enforcement order. Additionally, the commission approved an extension request for an existing order on Northern Boulevard, extending it to November 8, 2024.
Certificates of compliance were issued for two properties. The first certificate was for 7 Hutchinson’s Road, where minor modifications from the original plans, such as the relocation of air conditioning units and an increase in propane tanks, were noted during an inspection. The commission found no concerns and approved the certificate. The second certificate pertained to another property, with no further questions or issues raised by the members.
The commission also discussed an expired order of conditions for a project at The Rotary, emphasizing the need for an enforcement order to halt further work until a new order was approved. A zoning update from Town Council regarding additional dwelling units (ADUs) was presented. This raised potential concerns about the impact on existing neighborhoods.
Further discussion included the condition of the old boathouse near Bob’s Lobster and the review of 34 Central Street under Massachusetts General Law chapter 61a, governing farmland tax exemptions.
