- Meeting Overview:
In a recent meeting of the Brevard County Local Planning Agency, discussions emerged around amendments to the county’s stormwater management and flood protection codes, reflecting ongoing concerns about infrastructure resilience and community safety. The meeting saw the board grappling with the technicalities of stormwater infrastructure, flood insurance regulations, zoning requests, and public transparency.
The most significant agenda item was a request for a recommendation regarding amendments to the Brevard County Code of Ordinances concerning stormwater management criteria. This proposal aimed to allow the use of polypropylene pipe as an additional option in county rights-of-way and introduce administrative waivers for inverted siphons under specific criteria for commercial sites. The engineering staff confirmed that the Department of Environmental Protection had approved polypropylene pipe in 2014, noting its stiffness and favorable track record compared to black HDPE pipe.
Despite the technical endorsement, the board expressed mixed feelings about entering the “pipe approval business.” One member voiced skepticism, citing historical apprehensions about the board’s involvement in such approvals and the potential public perception issues. Another member with drainage engineering experience supported the use of polypropylene pipe, mentioning its acceptance in Florida and its capacity to withstand vehicle loading. However, the conversation shifted towards the placement conditions of inverted siphons, leading to a motion to amend the language from “in residential developments” to “adjacent to residential developments.” This motion, aimed at addressing concerns about flooding and overflow impacts on neighboring properties, passed unanimously.
Another crucial discussion centered on item H2, which addressed code revisions related to flood damage protection. The proposed changes sought to ensure compliance with the Community Rating System (CRS) for flood protection and insurance rebates. The board deliberated on the removal of the repetitive loss definition from the ordinance, with one member, serving as a consultant to FEMA, questioning this decision’s implications. The staff explained that the state is moving towards a uniform ordinance, prompting multiple jurisdictions to remove repetitive loss definitions to align local standards with federal guidelines.
Concerns were raised about potential impacts on flood insurance costs and the importance of utilizing FEMA’s definitions in local ordinances to facilitate grant acquisitions and compliance with federal guidelines. The board stressed the need for clarity on how the ordinance updates would affect mobile home placements and overall flood risk management.
Additionally, a public comment session highlighted issues with accessing meeting minutes and proposed changes to the Local Planning Agency’s structure. An audience member expressed frustration over the difficulty in locating meeting minutes on the county’s website, which led to a broader discussion about the proposed increase in the number of voting members to ensure quorum. The board clarified that the proposal aimed to streamline the voting process, especially for volunteers participating in lengthy meetings.
The meeting also addressed several zoning classification changes. The board recommended approval for a request from Strickland Development LLC to change zoning from BU-2 to AU, a continuation from a prior meeting. Similarly, a request from Put It In Me Storage LLC for a change from IU to BU-2 was approved, intended for RV and storage parking. Another request involved Judith Baker’s proposal for a small-scale comprehensive plan amendment to change the future land use designation from residential to commercial, accompanied by a zoning change from general use to business. Baker’s proposal aimed to provide mini self-storage and outdoor parking for RVs and boats to service the growing residential developments in the surrounding area.
Further zoning changes included requests from Robert Corbett, Shi Noah and Kimberly A. Noah’s trust, and Edwin and Stephanie Silva, all of which were approved with minimal opposition. These changes reflected ongoing efforts to align property uses with community needs and developmental plans.
The meeting concluded with discussions on the proposed modifications to the Local Planning Agency’s structure, aimed at increasing the number of voting members to ensure quorum and streamline the voting process for volunteers. The board assured that further discussions would occur in the upcoming County Commission meeting to address these structural changes and the accessibility of meeting minutes.
