Deia emphasized that immediate action was required for site improvements, stating, “We want to get started cleaning up the site and making improvements.”
The tension between the applicant and the estate of Mrs. R was also evident. Tom Barto, representing the estate, expressed frustration over the applicant’s alleged non-compliance with lease obligations and environmental cleanup responsibilities. Barto stated, “He has done nothing to continue with the environmental cleanup like he’s supposed to,” highlighting the estate’s desire to see the applicant vacate the property to facilitate necessary cleanups. Deia clarified that contractual obligations had not been breached and both parties were committed to resolving the matter.
The board also addressed the incomplete status of the site’s preliminary environmental assessment. Concerns were raised about contaminants, specifically benzene, and the feasibility of reoccupying the site under current conditions. The board emphasized the importance of adhering to public health standards, with one member stating, “having somebody occupy a site that is known to have Benzene and other contaminants… we’re all doing the wrong thing.”
The meeting further highlighted logistical challenges in scheduling the next review, with potential delays to November or December. The board discussed the necessity of proper re-noticing for variances and the importance of determining the application’s completeness before proceeding.
In addition to environmental concerns, leadership changes were a focal point of the meeting. Following the resignation of Mr. Cifer as chairperson, Vice Chair Tom McKay was nominated and confirmed as the new chair through a unanimous vote. Subsequently, a new vice chair was elected.
The board also reviewed an application related to a property on Fostertown Road, where the applicants sought to demolish an early 1900s house and replace it with a new structure set further back from the road. This application required variances due to the proposed setbacks being less than the mandated 125 feet. The board’s planner noted the substantial increase in setback and acknowledged the challenges of adhering strictly to setback requirements, given the neighborhood’s existing patterns.
They emphasized the importance of checklist compliance, particularly concerning stormwater management and impervious coverage, to facilitate informed decision-making.
The meeting concluded with a brief public session and closing remarks, including an offer from a resident to assist the community with grant writing. The board welcomed this offer and encouraged the resident to engage with relevant officials.
