This increase of approximately 9 feet represented a significant enhancement over current conditions.
The board’s discussion placed considerable emphasis on public health and safety, underlining the necessity of a thorough application process. Some members questioned the need for a variance, given the design’s compliance with setback requirements. However, Landry and Chau’s “belt and suspenders” approach ensured all bases were covered in case the board deemed a variance necessary. The board ultimately determined that a variance was not required, as the design met local bylaw standards.
Public comments were invited during the deliberations, with Dyson expressing his plans to build a home for himself and his fiancĂ©e. He anticipated minimal traffic impact, estimating the need for only two cars. Questions also arose about the neighborhood, particularly the management of Massa Squatch Road. Dyson confirmed the existence of a homeowners’ association responsible for road maintenance, including snow removal.
The board members collectively sought clarity on the application. A member voiced that the project, which involved replacing an existing house with a new one, met all setback requirements and would not increase detriment to the neighborhood. The improved septic system was also noted as a mitigating factor for potential issues.
Following the discussion, the board agreed unanimously to grant Dyson’s administrative appeal. It was noted that there is a 20-day grace period before any demolition can commence, allowing for any potential objections or appeals from the community.
Subsequent to discussing the appeal, the board briefly addressed other agenda items. These included a proposed subdivision plan for a property on Old Harbor Road and updates from the short-term rental subcommittee. The board clarified its role as primarily advisory regarding the subdivision, as it lay outside their direct jurisdiction. The subcommittee reported progress on drafting a new bylaw, emphasizing the importance of collaboration with the planning board on updates related to accessory dwelling unit laws.
