- Meeting Overview:
In a recent meeting, the Manchester-By-The-Sea Select Board approved a special permit for a contentious renovation project on Rockwood Heights Road. The permit allows the reconstruction of a non-conforming residential structure, despite concerns about increased height and volume due to a new deck and second-floor expansion.
The hearing was officially called to order to discuss Carlos Delgado’s application for a special permit, which involved reconstructing a non-conforming structure that encroaches on setback requirements. The existing building had a corner sitting only 17 feet from the property line, falling short of the required 20-foot setback. This discrepancy, coupled with the applicant’s mid-construction discovery that necessary permits were not in place, necessitated the current application.
A detailed examination of the proposed changes ensued, focusing on the impact of the increased height and mass of the building. Although the footprint would remain unchanged, the planned alterations would raise the roof line and expand the structure’s volume. Deliberations highlighted discrepancies in the project’s documentation, with conflicting reports about the total square footage. Initially, an addition of 153 square feet was cited, yet other documents referenced 1,687 square feet. This inconsistency prompted a deeper inquiry into the measurements, including deck dimensions, which varied across documents.
The discussion also touched on the relationship with neighboring properties. It was noted that nearby residents expressed satisfaction with the proposed renovations, anticipating improvements to the condition of the existing house. A neighbor’s approval was particularly emphasized.
As the board considered closing the public hearing, members expressed their views on the project. One member remarked that the renovations would enhance the current structure and were reasonable given its non-conforming nature. The project was seen as not excessively intrusive and unlikely to harm the neighborhood’s character. Another member concurred, noting that the volume increase would not detract from the community.
The motion to approve the special permit was made, outlining specific sections of the zoning bylaw under which the permit would be granted. The motion stressed alignment with submitted plans and asserted that the expansion would not disrupt the neighborhood. The board members voted in favor, with one indicating they would have supported the motion if eligible.
Following the permit approval, the board attended to administrative tasks, reviewing and amending the previous meeting’s minutes to clarify details regarding a ceremonial room and proposed structure dimensions. These amendments were accepted, and the revised minutes were approved. The board also discussed the scheduling of future meetings and site visits, considering holiday conflicts and school vacations. It was decided to move site visits to Saturdays for November, with meeting schedules adjusted for Thanksgiving and Christmas.
