Legal complexities arose during the meeting concerning an adjacent Liberty Harbor North property, with disputes over the master deed’s stipulations and the rights to parking spaces. The applicant’s attorney contended that the project was within legal bounds, arguing that the master deed allowed for residential development and that parking rights were secured through a perpetual easement. This was challenged by an opposing attorney, who maintained that the property’s master deed only permitted hotel development and raised issues over the parking allocation. The board recognized these disputes but maintained that they fell outside the purview of its decision-making authority.
Beyond the Liberty Harbor North project, the board also addressed amendments to the Westside Avenue Redevelopment Plan. The amendments sought to expand permissible uses for a property owned by Westside Holdings, including retail, office, and restaurant spaces. The planning staff confirmed the consistency of these amendments with the city’s master plan, leading to a favorable recommendation to the city council.
Additionally, the board approved updates to the city’s Land Development ordinance, aimed at clarifying local landmark designation standards, aligning with efforts to achieve certified local government status.
