The initial proposal included an access driveway through Pine Street from Highland Avenue, but the gas company’s stipulation that all utilities be located outside of the easement led to the exploration of alternative routes. The board scrutinized the new access plan, which proposed a route through Bentley Lane, raising concerns about the length of the dead-end street, which exceeded the permissible 1,200 feet. The proposed design stretched approximately 3,300 feet, over the limit, thus raising safety concerns regarding emergency service access.
Board members highlighted the unresolved title issues with adjacent property owners, notably with Warren Messier, necessitating legal reviews to clarify rights related to Bentley Street and associated easements. The board emphasized the importance of obtaining a legal opinion from the Town Council to ensure informed decision-making.
An alternative access from Oak Street was also considered, although potential wetland crossings and the need for wetland replication added to the project’s challenges. The board was apprehensive about approving an application that requested a waiver for such a significant extension beyond subdivision standards.
The board also dealt with another significant agenda item: the extension of a special permit for Ironwood Renewables LLC. Originally granted on May 31, 2022, the permit faced a 683-day delay due to a failed appeal. The board approved extending the permit to April 30, 2027, under Massachusetts General Law Chapter 40A, Section 17.
Beyond these discussions, the board addressed procedural complexities related to a subdivision application for Oak Street. The historical context of Railroad Park, which predates subdivision control law, added layers to the board’s deliberations. Members expressed uncertainty about the rights over old paper streets, emphasizing the need for the applicant to resolve title issues with a title attorney. There was a suggestion that combining two lots might simplify access to the property, though the land’s complex ownership history posed additional hurdles.
Environmental impacts were also a focal point, with discussions about using Pine Street, which was already cleared for gas lines, versus Oak Street, which would require additional clearing. Members noted that utilizing a pre-cleared route would be less environmentally impactful, though complications with the gas easement and right-of-way widths remained.
The meeting also included updates on other projects and administrative matters. A public hearing concerning a new storage building on American Legion Highway was continued to December 3, 2024, to allow the applicant’s engineer time to adjust plans. The board noted the need for a fire access lane and stormwater management improvements, as current plans did not meet reduction requirements for storm events.
In administrative updates, the board prepared to enter an executive session to discuss the assistant planner position, ultimately recommending Anory Patel for the role. Additionally, the board received news of a Coastal Zone Management Grant for $1,174,175 to develop beach management plans, with $234,000 allocated for public engagement efforts.
