- Meeting Overview:
The Southwick Conservation Commission’s recent meeting, held on November 4, 2024, focused on several issues, including the approval of a single-family dwelling project on Henry Road and ongoing regulatory compliance for various local projects. The meeting explored ecological preservation efforts, potential amendments to existing Notices of Intent, and the intricacies of dock ownership and compliance.
The most pressing topic of the meeting was the deliberation over a proposed single-family dwelling on Henry Road, which involves site improvements encroaching upon a protected buffer zone. Ryan Nelson from Arc Associates presented the project, explaining that the majority of the house and septic system would be within the buffer zone. Despite plans to adhere to the 50-foot no-touch buffer, the project raised concerns about potential encroachment. The prospective buyer’s requirement for conservation permit approval was highlighted, prompting discussions about applying for a variance to allow a backyard area.
The commission weighed the risk of construction near the buffer zone against the benefits of a variance, which could reduce disturbance. Although there was no guarantee of approval from the zoning board of appeals, the commission agreed to approve the project with the stipulation that the applicant pursue a variance and return with an amended plan if successful. Conditions were discussed, such as the removal of invasive species and the planting of native flora to enhance the buffer zone. The emphasis on minimizing future encroachments through signage and planting measures was noted, and ultimately, the commission aimed to streamline the process while ensuring enforceable conditions for the buffer zone.
Another discussion involved properties at 24 and Nicholson Hill Road, which have isolated wetlands. The commission discussed potential amendments to the original Notice of Intent (NOI) versus submitting a new one. Members deliberated over the delineation process and the management of isolated wetlands under local bylaws versus the Wetlands Protection Act. The historical context of past successful amendments was considered, and the commission decided to approve an amended NOI, acknowledging the new delineation and the relocation of the septic system, provided it remained outside the 100-foot buffer.
The meeting also addressed ongoing compliance and procedural matters. The installation of plaques on boulders to mark buffer zones and the necessity of preconstruction site requirements were discussed. The commission considered the use of cash instead of bonds, simplifying the process while maintaining erosion control measures before construction begins.
In other business, a request for a certificate of compliance for a property on Feeding Hills Road was discussed, with the commission noting improvements in flood storage and the impact of increased impervious surfaces due to a walkway. The addition of rubs and small trees along the stream was acknowledged, and the commission expressed the need for clear documentation on floodway and high-velocity areas. A motion to approve the certificate of compliance was made, with the representative confirming that no buildings were located within high-velocity flow areas.
The conversation about dock removal on Lake View Street was another focal point. Concerns about safety and visibility, particularly during the winter, prompted a suggestion to install reflective markers or lights on the dock. The applicant agreed to comply with these safety measures, and a motion to approve the variance for both the dock and the associated boat lift was passed with the condition that safety measures be implemented.
