- Meeting Overview:
During a recent meeting of the Seminole Special Magistrate, property compliance issues dominated discussions, with several cases highlighting difficulties in navigating the permitting process and addressing violations. Among these, a significant case involved a property on Shady Lane in Geneva, where ongoing land development code violations led to an extended compliance deadline. Other notable discussions included a series of non-compliance cases, challenges with permit applications, and the imposition of fines and liens.
One notable matters involved the property on Shady Lane, which had been under scrutiny for violating the county’s Land Development Code. Officer Hill from the Seminole County Sheriff’s Office presented details of the case, noting that despite the removal of a camper, the property remained in violation. With an initial inspection dating back to July 19, 2023, and a follow-up on November 22, 2024, Officer Hill recommended the imposition of a lien, retroactive to December 4, 2024, until compliance was achieved. In response, a representative for the respondent, Mark Jones, requested a delay in the magistrate’s decision, citing a pending appeal scheduled for January 27. Acknowledging the upcoming board meeting, the magistrate extended the compliance date to February 12, 2025, with a hearing set for February 13, 2025.
Another case concerned Cynthia Greco, who purchased a home only to discover unpermitted alterations by the previous owner. Greco had reached a settlement with the former owner, who agreed to cover financial responsibilities for the required corrections. Facing delays in the permitting process, Greco expressed concern about meeting compliance deadlines. The magistrate, understanding the situation, extended the compliance date to March 12, 2024, with a penalty of $150 per day for continued non-compliance, while acknowledging that any fines would be covered by the settlement.
The Seminole Special Magistrate also addressed several cases involving unpermitted structures. A property on Wind Drive was cited for enclosing a carport without proper permits. Inspector Jason Rucker recommended a compliance deadline of February 12, 2025, with a fine of $50 per day for non-compliance. Similarly, Mary Beth and Tyler Carlson faced issues with an unpermitted patio pergola at their property on Alder Avenue. Despite previous compliance efforts, the magistrate emphasized the need for a new permit application following the closure of the previous permit due to inactivity.
In one instance, a property owner, using a Spanish interpreter, recounted purchasing a house with an unpermitted guest house. Miscommunication with the real estate agent and the architect led to delays in addressing violations. The magistrate set a new compliance deadline for February 12, 2024, with a follow-up hearing scheduled for February 13.
The meeting also highlighted cases where administrative costs and liens were imposed. For a property on Collins Drive, the magistrate recommended a lien retroactive to August 12, 2021, accruing until compliance was achieved. Similar actions were taken for properties on Centerville Way and Tusca Road, where administrative fees were set, and potential liens discussed.
Additionally, the magistrate addressed ongoing issues with a gate and interior renovations at another property. Miscommunication regarding the need for a separate permit for the gate complicated compliance efforts. The magistrate allowed the property owner additional time to explore options, including a potential variance, to address the gate’s compliance with fire regulations.
