- Meeting Overview:
The Mount Olive School Board meeting focused on debates surrounding a $152,000 allocation from taxpayer funds to supplement an insurance settlement regarding tenure charges against former superintendent Dr. Robert Zwicki. The board also navigated election results, ethics, and governance issues amidst public scrutiny and complex legal challenges.
A primary point of contention was the board’s decision to allocate $152,000 of taxpayer money to cover additional costs associated with a legal settlement concerning Dr. Zwicki. Many attendees voiced strong opposition to this allocation. Martin Wellsmore, a vocal attendee, criticized the board’s use of taxpayer funds for the settlement, questioning the decision’s impact on district programs and services. Wellsmore emphasized, “The board is supposed to act as a steward of taxpayer funds… paying $152,000 taxpayer dollars to supplement an insurance settlement abdicates this responsibility.”
Christopher Zy, another member of the public, challenged the validity of the tenure charges, stating they were never ratified and had expired. He expressed concern about misinformation, particularly regarding a supposed involvement of a federal mediator in the case. Karen F, also in attendance, shared her frustration, asserting that spending taxpayer money on this settlement would be an insult to the district’s children and staff.
Despite these objections, the board proceeded with the settlement. Several board members voted against the allocation during a roll call vote. Jennifer Aquino and Lauren Fitzgerald were among those who opposed the decision, though they supported other agenda items. The controversy elicited calls for enhanced transparency and better communication regarding board decisions.
In addition to the settlement issue, the meeting included the board’s annual ethics review, led by Board Attorney Mr. Gerer. He reminded members of the importance of adhering to ethical standards, emphasizing the prohibition of financial interests in board contracts and the need for confidentiality in sensitive matters. Mr. Gerer underscored that the board’s actions should prioritize educational welfare and avoid administrative duties beyond their policymaking role.
The meeting also addressed the election results from November 18, 2024, with the certification and swearing-in of three new board members: Jennifer Aquino, Anthony Giordano, and Lauren Fitzgerald. These members pledged to uphold the Constitution and fulfill their duties impartially.
Following the election of new members, the board conducted officer elections. Lisa Nares was elected as president, and Lisa Fenton as vice president, both confirmed through roll call votes despite some abstentions and opposing votes. Nares then assumed control of the meeting, guiding discussions on the appointment of various representative positions, which were ultimately deferred to a future meeting.
The board also faced legal and ethical challenges related to conflicts of interest involving Dr. Zwicki’s litigation. A resolution was passed invoking the doctrine of necessity, allowing board discussions despite conflicts involving six members, including Giordano and Aquino, who were named defendants in the ongoing litigation. This resolution will be presented at a public meeting scheduled for January 6, 2025, and posted for 30 days for transparency.
Public comments following the ethics review included congratulations to the newly elected board officers and criticism of the legal settlement requiring taxpayer funds. A former board secretary of 32 years highlighted discrepancies in handling such settlements. The speaker warned of setting a “terrible precedent” for future litigation by requiring additional taxpayer money beyond insurance coverage, pointing to specific allegations against Dr. Zwicki, including misconduct and extortion attempts.
As the meeting progressed, attendees like Zy revisited the floor, demanding clarity on the board’s policies and actions regarding confidentiality breaches and the alleged sharing of proprietary information by a board member. The board was urged to implement policies addressing such issues to maintain trust and integrity.
