Gardner Conservation Commission Debates Tree Removal and Construction Plans
- Meeting Overview:
The Gardner Conservation Commission meeting focused on critical environmental issues, including tree removal, construction projects, and compliance with regulations. The commission unanimously approved a determination of applicability for Crestwood Drive and discussed enforcement orders, compliance certificates, and a range of proposals impacting local wetlands and natural resources.
The commission’s deliberations on tree removal on Snake Pond Road were a highlight. A request was made to remove trees within the buffer zone of a bordering vegetated wetland, citing concerns about the trees’ health and potential danger from falling branches. However, commission members raised ecological concerns, emphasizing the importance of maintaining tree cover to prevent increased water temperature in the nearby pond, which could lead to algae growth and higher bacteria levels. The discussion included diverse opinions on the trees’ actual condition, with some participants expressing skepticism about their perceived health risks. The commission ultimately recommended consulting a certified arborist to evaluate the trees’ health and explore alternatives, such as pruning, before any decision on removal is made. This topic, due to its complexity and environmental implications, was scheduled for further discussion at the next meeting on January 27.
The meeting also addressed a joint public hearing for a project on Pearl Street, involving the installation of utilities within a buffer zone. The project, presented by TR Bridge Engineering, aimed to tackle drainage issues. The representatives confirmed that project details had not changed since its last presentation in 2020. The discussion included specifics on drainage structures and materials, yet there were no further questions or concerns from commission members. This led to motions to close the hearing and approve the project under standard conditions.
In another discussion, the commission examined plans for a single-family home on Acadia Road. The project had undergone several revisions to meet zoning requirements, with the house set to be positioned 49 feet from the property line and maintaining an appropriate distance from wetlands. However, a proposed concrete patio within a no-build zone sparked concerns. Commission members questioned whether permeable materials might be more suitable than concrete to promote water infiltration. Suggestions included using stepping stones or a stone trench. The representatives expressed surprise at the feedback. The commission requested a written agreement detailing modifications to the patio, leading to motions to close the hearing and approve the project with conditions, including the incorporation of a stone trench.
The enforcement order concerning 36 Nicole Terrace was another focal point. A representative addressed the commission about unauthorized tree removal near wetlands. The commission highlighted potential environmental ramifications, such as wetland drying or damage to drinking water sources. They stressed the need for a planting plan to mitigate the damage and suggested consulting a third-party engineer to assist in crafting a comprehensive rectification strategy. The representative agreed to work with an engineer known to the commission and present a plans at the next meeting. The commission made it clear that no immediate actions should be taken until the plan is reviewed and approved.
Discussions also touched on the completion of a certificate of compliance for a property on Pearl Street, aimed at closing out an old order of conditions to facilitate a new project. The motion for approval received unanimous support.
Additionally, the commission considered an update on the nature trail, where inspectors identified cracks and areas prone to washouts. Plans were in place to apply a top coat in the spring, with further attention to problem areas. The commission requested updates on project expenditures.
