Clay County Board of Commissioners Reviews Rezoning and Land Use Proposals
- Meeting Overview:
During a recent meeting, the Clay County Board of Commissioners focused on significant land development and rezoning proposals, including the Red River Valley Co-op’s request for a rezoning that would enable the construction of a major distribution warehouse and service center, as well as an interim use permit for a bed and breakfast.
The meeting’s most newsworthy topic was the Red River Valley Co-op’s petition to rezone a parcel in Oakport Township from Agricultural General Urban Expansion District Tier 2 to Highway Commercial. The proposed development includes a 40,000 to 60,000 square foot distribution warehouse on 15 acres, with an estimated cost between $12 million and $15 million. Additionally, the project plans feature a service center on a separate 5-acre lot, including office and shop space for 5 to 7 employees, scheduled for completion between 2026 and 2028.
Detailed discussions ensued regarding the rezoning’s compatibility with the county’s comprehensive plan and existing land use, emphasizing the project’s alignment with the Highway Commercial District. The development’s location, at the intersection of County State Highway 18 and 34th Street, is within Dilworth’s extraterritorial area, granting subdivision jurisdiction to the city, while zoning authority remains with the county. The project received recommendations from the Dilworth Planning Commission and city council, contingent on utility easements and access regulation compliance.
Rich Whitcomb, CEO of the Red River Valley Co-op, addressed the board. A resident from Moorhead voiced opposition, expressing concern over the development’s impact on the rural area’s character. The board proceeded to examine the potential community effects as part of their decision-making process.
Another agenda item was the request from Trenton and Jennifer Evenson for an interim use permit to operate a bed and breakfast in a zone classified as Agricultural General. The proposal involves using renovated agricultural buildings to create a four-bedroom guest suite and converting grain bins for additional guest accommodations, totaling up to 22 guests. The Evensons, familiar with the area, intend to contribute to the community by providing a gathering place for families and groups.
Concerns were raised about the bed and breakfast’s operation amid agricultural activities, with neighbors worried about noise and light pollution during peak farming seasons. The Planning Commission acknowledged Minnesota’s right-to-farm laws, which protect agricultural operations from nuisance claims, and discussed the importance of the Evensons’ compliance with local health regulations.
In another development, the board reviewed a request for a five-year extension of a temporary asphalt plant permit for RJ Zaval and Sons in Hagen Township. The plant, situated on an 80-acre parcel, has a history of permits for asphalt batch plants and gravel mining operations dating back to 2010. Discussion focused on dust control and environmental impacts, with residents expressing health concerns due to dust and odors, particularly during high winds. The board emphasized the need for the applicant to address these issues, considering the site’s proximity to prime wildlife habitat and residential areas.
Public comments included a resident expressing concern for their child’s health and the asphalt plant’s potential impact. The board acknowledged these concerns and discussed imposing conditions related to dust and odor control.
The meeting also addressed potential conflicts of interest and environmental considerations, with a resident seeking clarification on permit durations and advocating for environmental protections. The board concluded by approving a five-year interim use permit extension with conditions related to odor mitigation and other environmental factors.
