Cranbury Zoning Board Approves Temple Renovations Amid Drainage Concerns and Jurisdiction Debates
- Meeting Overview:
During the March 5, 2025, meeting of the Cranbury Zoning Board, members approved an application for renovations at the Chimaya Mission, including the installation of a sunroom and accessibility improvements. This decision came amidst discussions on drainage challenges and jurisdictional disputes over a separate Main Street redevelopment issue.
The primary focus of the meeting was the Chimaya Mission’s application to construct a sunroom, improve a porch, and add an ADA-accessible ramp at their Cranbury Neck Road location. The attorney representing the mission, Matthew Flynn, outlined the request for a D2 use variance due to the site’s pre-existing non-conforming status. Witnesses, including a civil engineer and an architect, provided detailed testimony on the proposed improvements, emphasizing the need for enhanced accessibility and protection from weather conditions.
The civil engineer, identified as Jay Patel, described the site’s layout and the planned modifications, which included enclosing a patio into a sunroom and constructing an ADA-accessible route. Despite the increase in impervious coverage from 25.8% to 26%, the Environmental Commission expressed no objections. The architect confirmed that the improvements would not expand the building’s capacity but would improve safety and usability, especially for congregants.
The board’s discussion also delved into the necessity of variances due to existing conditions, such as rear yard and side setbacks, which the proposed sunroom did not fully satisfy. The board planner, Elizabeth Leheny, and other members sought assurances that the improvements would not adversely impact surrounding properties.
Public comments introduced concerns about longstanding drainage issues on Cranbury Neck Road, a county road. Residents like Roger Jany voiced apprehensions over potential exacerbation of these problems due to the proposed renovations. In response, board engineer Dave Hoder acknowledged past drainage challenges and suggested potential mitigation strategies, such as redirecting runoff to dry wells or grassy areas.
In a separate matter, the board engaged in a protracted dialogue about jurisdiction over a redevelopment application for a Main Street location. The issue stemmed from a lawsuit filed against the township committee after it rejected a request to amend the Redevelopment Plan. A judge had directed the parties to seek a variance from the zoning board as a step in the legal process.
This directive sparked a debate among board members about the appropriateness of their jurisdiction. Some members argued that the zoning board should not entertain the application, given the township committee’s previous decisions. Others maintained that the board had the legal authority to grant variances, despite the township committee’s stance. The board’s discussion highlighted differing interpretations of the judge’s ruling and the complexities of zoning authority.
Amidst these debates, the board also addressed procedural concerns, such as the Development Review Committee’s repeated cancellations and potential conflicts of interest involving one board member. These issues underscored the broader challenges of navigating local governance and zoning regulations.
