Volusia Planning Commission Tackles Housing Variances and New Ordinance for Sober Houses
- Meeting Overview:
The Volusia Planning Commission convened on November 20, 2025, to address a range of issues, including variance requests for residential properties and a newly mandated ordinance concerning certified recovery residences.
A significant portion of the meeting was devoted to discussing variance requests, notably case V-25-064, which sought to modify yard requirements for a proposed addition to a residential property. The variance aimed to reduce the front yard requirement from 30 feet to 19 feet to accommodate an ADA-accessible living space for the applicant’s mother. The property in question was on a corner lot, complicating the layout and prompting the need for a variance. Staff recommended denial, arguing that the corner lot configuration did not warrant a unique condition. However, strong personal testimonies from the applicant and her mother, supported by a neighbor, underscored the importance of accommodating multigenerational housing needs.
Commissioner Costa moved to approve the variance, noting the increasing demand for accessory dwelling units (ADUs) to facilitate aging in place. This sentiment was echoed by other commissioners, who agreed on the necessity of streamlining processes for similar requests in the future. The motion to approve the variance was carried unanimously.
Another notable variance case, V-25-058, involved a request for reduced setbacks to construct an inground swimming pool and screening enclosure. The applicant justified the variance by highlighting the pool’s intended use for low-impact hydrotherapy. Despite staff recommendations for denial, citing unmet criteria, the commission approved the variances unanimously after considering the applicant’s arguments and lack of objections from environmental permitting.
The commission also deliberated on a variance request for a carport on Broad Avenue, Daytona Beach. The applicant, Elizabeth Parker, sought clarity on extending the structure beyond the proposed dimensions due to a neighbor’s prior land encroachment. The commission approved the variance, emphasizing compliance with minimum criteria and support from neighboring properties.
One discussion arose surrounding a proposed ordinance, number 2025-26, which aimed to establish a process for requesting accommodations for certified recovery houses. State legislation required local jurisdictions to implement such ordinances by January 1, 2026. The ordinance outlined procedures for certified facilities to seek accommodations when their management practices conflicted with local development regulations. The commission explored concerns about appeal processes and the impact on residential neighborhoods, ultimately recommending an extension of the appeal period from 30 to 90 days.
Further discussions touched on the potential for administrative rezoning to address challenges faced by substandard lot sizes, particularly in agricultural zones. The commission recognized the disconnect between existing zoning regulations and actual parcel sizes.
The meeting concluded with a review of the commissioners’ stipend, which had remained unchanged since 1987. Additionally, logistical matters such as distribution methods for meeting materials and clarification of agenda items were addressed.
