The proposal allows for retail and office uses with operations confined to buildings. Despite the potential for the zoning to be considered spot zoning, Bush claimed it served as a transitional district with necessary buffering and performance standards.
Staff presentations highlighted that while the HCLI designation would allow more intense uses, it did not meet the location criteria specified in the land development code, which requires parcels to be on arterial or collector roads. Instead, the staff suggested commercial zoning as more appropriate, maintaining a lower intensity and serving as a transition between high-density mixed use and heavy commercial or industrial areas.
During the public comment section, local residents voiced their opposition. Melissa Johnson, a resident on Kenmore Road, expressed concerns about declining property values and increased congestion. She highlighted the area’s existing traffic issues, stating, “I’m actually closer to the particular lot than anyone else probably is,” and feared the impact of increased heavy truck traffic. Beverly Bins echoed these sentiments, worrying about her grandson’s safety amid potential traffic increases, stating, “I don’t want my grandson not to be able to ride his bike up and down the road because of all the heavy traffic.”
The board acknowledged the validity of these concerns, noting that while they related to broader community issues, the specific rezoning request met the established criteria. The board emphasized the complexities of balancing development needs with community character and highlighted that increased zoning intensity typically leads to heightened traffic and community impact.
In another significant case, the board approved a rezoning request for a property on Highway 99 from agricultural to rural residential. This shift allows for increased residential density, with the RR district permitting one dwelling unit per four acres compared to the agricultural designation’s one per 20 acres. Staff underscored that this change would not require new public infrastructure, thus avoiding urban sprawl.
During public comments, Matt Crosby, whose property is near the rezoning site, raised concerns about potential conflicts between increased residential density and agricultural activities. He highlighted issues such as noise from the nearby Escambia County 4-H Agricultural Extension Center and insufficient water lines for fire safety. Despite these concerns, the board determined that the rezoning met the necessary criteria, emphasizing the area’s gradual growth and compatibility with existing land uses.
