Chatham Historical Commission Grants Continuance for Elephantes Lane Application
- Meeting Overview:
In a session marked by extended debate, the Chatham Historical Commission voted to grant a continuance for an application concerning the property on Elephantes Lane. The decision, made during the meeting on February 3, 2026, followed discussions about the preservation of the Old Village National Register District and the implications of FEMA flood zone regulations.
The application, identified as number 2543, has been a subject of ongoing deliberations since October, involving negotiations with the Cape Cod Commission and the local building inspector. The applicant, represented by Bill Riley, requested a continuance to March 17, 2026, to further address concerns and potentially reach a compromise with nearby residents. The property lies within the Old Village National Register District, raising concerns among residents and the Old Village Association about preserving the area’s historical character.
The decision to grant the continuance was not without contention. One commission member expressed concerns about the repeated requests for continuance without substantial progress. The member drew parallels to the zoning board’s approach, where repeated continuances without progress have been denied.
A point of discussion was the potential involvement of the Cape Cod Commission, which some members noted had a history of approving similar applications. The commission expressed reluctance to refer the application to the Cape Cod Commission, given the uncertainty about how it would be handled there. Concerns were raised about the Cape Cod Commission’s authority to override the historical commission’s decisions under the Cape Cod Commission Act if the application was deemed detrimental to the National Registered District. This led to expressions of frustration about the limitations on the board’s decision-making power.
Michael Ford, representing immediate abutters, assured the board that progress was being made towards an alternative plan. He noted that there had been meetings with the building commissioner and suggested that they could withdraw the application without prejudice, allowing them to return once a proper plan was in place. This option was seen as a way to alleviate ongoing pressures. The commission chair acknowledged the need for clarity on procedures regarding withdrawal without prejudice, as it was not typically part of their protocol.
Ultimately, a motion was made to continue the review of the property application to March 17, 2026, with the condition that the applicant provide detailed information on a revised application by March 11, 2026. The motion passed with unanimous support from those present.
In other business, the commission noted that there were no new applications for upcoming meetings on February 17 and March 3. The chair also mentioned potential changes in commission membership, with two applicants being considered for appointment. One applicant had been interviewed by the select board, while the other brought construction experience that could benefit the commission. Additionally, a long-standing member was contemplating stepping down, which could lead to further changes in the commission’s composition.
