Victoria Planning Commission Approves Rezoning and Subdivision Amidst Environmental Concerns

The plan outlined the creation of two new buildable parcels along with one non-developable lot to be deeded to the city. McCann emphasized that the proposed density of approximately 0.8 units per acre was well within the low-density guidelines stipulated in the comprehensive plan, which allows for up to six units per acre.
However, the proposal was not without contention. David Stark, an adjacent resident, voiced concerns during the public hearing. He argued that the property had already reached its residential carrying capacity and that additional homes would lead to overdevelopment, posing a threat to the local environment. Stark highlighted the discrepancy between the claimed low density, which was based on the total land area, including wetlands, and the actual buildable area of 3.75 acres. He accused the proposal of disguising a high-density cluster development and called for independent verification of tree removal rates. Stark also pointed out the absence of permits for open burning during previous land clearing, questioning the potential impact on rare or endangered species in the area.
In response to these concerns, McCann assured that the development would adhere to local regulations. The proposal included efforts to limit tree removal to less than 20% of the site, thereby avoiding additional mitigation requirements. The discussion also covered the necessity of a plan amendment to extend sewer services to accommodate the new parcels, which McCann confirmed met all necessary criteria for lot size, width, and impervious coverage under the shoreland overlay district status.
Fire safety and emergency access were also key considerations. Given the current cul-de-sac configuration of Ridge Ponds Drive, the fire department recommended establishing a gated emergency access point to ensure efficient response times. The planning commission discussed the possibility of a public cul-de-sac, as preferred by the public works and engineering department, instead of maintaining a private street, although this remained a point of negotiation with the applicant.
The public hearing concluded with the applicant, Neil Clinkitz, expressing his intent to preserve trees on the property and create lots for his children. He emphasized that the project’s scale was reduced to maintain environmental considerations. Following Clinkitz’s comments, the commissioners engaged in a dialogue about the potential implications of the proposed development.
The commission acknowledged the community’s input. After thorough deliberation and clarification from staff about future utility connections and emergency access plans, a motion was made to recommend the proposal to the city council, with conditions specified by staff. This motion was seconded and passed unanimously.
In addition to the primary agenda item, the meeting included a presentation on another comprehensive plan amendment, focusing on compliance with drainage and utility easement requirements. The commission outlined next steps, including additional reviews by Carver County and the Minnetrista Conservation District. The necessity for a development agreement, covering standard fees and a letter of credit for public utilities, was also highlighted.
While the primary focus remained on the proposed subdivision on County Road 43, the commission’s discussions emphasized the balance between development and environmental preservation. The council meeting on February 9th will serve as the next critical juncture for this project.
