Titusville Code Enforcement Board Approves Extension for Church Playground Compliance Amid Safety Concerns
- Meeting Overview:
In a recent meeting of the Titusville Code Enforcement Board, members addressed a range of code violations, most notably granting an extension to the Indian River City Methodist Church for compliance regarding playground equipment located in a stormwater retention area. The board also dealt with cases involving unsanitary property conditions and unauthorized storage of a shipping container, imposing fines and liens for ongoing violations.
The board’s attention was primarily focused on the Indian River City Methodist Church, which faced a violation for installing playground equipment within a stormwater management area on its property on Cheney Highway. The church representatives, including Pastor Steuart Bodin and administrator Kelly McCluster, argued that the playgrounds had been safely used for over 30 years, serving over 500 families daily. They expressed concerns about the hardship of relocating the playgrounds, citing the financial burden and disruption to the church’s operations, which function nearly year-round. They assured the board of the safety measures in place, stating, “There’s almost zero chance of danger,” as the playgrounds are fenced and supervised.
Despite these assurances, board members highlighted the critical nature of stormwater management, especially given increasing storm activity and potential flooding. Concerns were raised about the risks associated with playground equipment in a stormwater retention area, emphasizing the city’s responsibility to ensure safety. One board member noted the importance of caution, saying, “I’d hate to be in a position where, you know, we grant that time frame and, you know, the worst happens.”
After extensive discussion, the board agreed to extend the compliance deadline to August 6, 2026. This extension would allow the church time to submit a permit application addressing the playground’s relocation rather than requiring immediate removal. The decision aimed to balance the city’s safety concerns with the church’s operational needs. If the church fails to comply by the new deadline, a fine of $100 per day will be imposed.
In another case, the board addressed a violation involving a large shipping container stored without a permit on Trevino Circle. Elizabeth Parker, representing the Solomon Family Trust, explained that the container was temporarily used to store household items during home improvements funded by a low-income loan from the city. Parker cited delays due to a hurricane and personal health challenges as reasons for the container’s prolonged presence. She requested leniency.
The board acknowledged Parker’s situation, granting her until March 6 to remove the container without incurring fines, although administrative costs of $171.50 were deemed unavoidable. The board allowed the costs to be paid over an extended period if compliance was achieved by the deadline.
The meeting continued with discussions on other properties facing code violations. The board reviewed a case involving a property on Golf View Drive, where multiple violations related to sanitation and maintenance were reported. The city representative detailed unsanitary conditions, including overgrowth and odors from numerous cats, with photographic evidence presented. A tenant reported the owner’s absence for several months, and the board emphasized the need for corrective actions, including debris removal and cleaning.
Another property on Lenor Avenue faced fines for failing to address exterior maintenance issues and drainage problems. The owner had received a permit for repairs but had not initiated any work. The board imposed a fine of $100 per day per violation starting February 7 if compliance was not met, with a lien to be recorded against the property.
