Brevard County Planning Board Approves Expansion of Borrow Pit and Restaurant Liquor License

The proposal to expand involves changes, including improvements to State Road 3, transitioning from asphalt millings to 150 feet of asphalt to accommodate increased traffic.
Rosena highlighted the appropriateness of the conditional use within the existing zoning regulations. She emphasized that the expansion would not negatively impact the current roadway infrastructure, assuring board members that traffic capacity was sufficient. The absence of wetlands on the property and the planned operational hours from Monday to Saturday, 6:00 AM to 4:00 PM, were also noted, with no public opposition voiced during the meeting.
Board members questioned aspects related to the easement leading to State Road 3 and the potential impacts on natural resources. Rosena confirmed that the easement was dedicated through government lands and that the company had engaged with natural resource authorities for eight months before the meeting. She assured the board that the applicant would certify no increase in flood stages, with required modeling and analysis to be conducted before issuance of permits.
The meeting further delved into technical details concerning the water table and excavation processes. Hart provided data on the area’s high water level, approximately one foot below the surface, while Jack Smith explained the ground elevations ranged from two to three feet above sea level. The method for dewatering during excavation was detailed, involving pumping water into a ditch surrounding the site, directing it into a controlled lake on the property. This system is designed to cease operations before major storms, allowing the lake to function as a floodwater sink.
The estimated 1.2 million yards of soil to be excavated raised questions about truck traffic and routes, particularly concerning Blue Origin’s plans for site elevation. While the majority of trucks would deliver directly to Blue Origin, some traffic was anticipated to head south, though specific destinations were not clarified. Concerns were voiced about the potential impact on neighboring properties due to altered runoff patterns, despite a lack of concrete information on Blue Origin’s construction plans.
Despite these concerns, the board expressed confidence in the compensating storage plan, leading to a unanimous approval of the expansion request. One member did express reservations about potential flooding and questioned the adequacy of existing models.
Following the borrow pit discussion, attention turned to the request from Princeton Technology LLC for a CUP allowing a full liquor license for a restaurant in Mims. Dr. Sachin Shenoi, the applicant, explained his desire to operate a bar at the location he had rented for nearly three years. Although the seating capacity fell short of the 120 seats required for a full liquor license, Dr. Shenoi expressed interest in exploring the bar concept in Mims, citing zoning process complexities as a source of confusion.
The public comment session revealed no support or opposition from attendees, prompting the board to focus on the CUP’s conditions. A board member suggested the permit apply solely to the restaurant under CNS Restaurants, Inc., Dr. Shenoi’s parent company. Dr. Shenoi agreed, noting it would safeguard his investment and ensure the location’s future viability.
