Sayreville Planning Board Adjusts Housing Plan Amid Property Dispute
- Meeting Overview:
In a meeting on March 4, 2026, the Sayreville Borough Planning Board addressed major amendments to the borough’s housing element and fair share plan, with discussions centered around the inclusion of specific properties and compliance mechanisms to meet housing obligations. The board also faced a dispute regarding the potential exclusion of a property from redevelopment plans.
The primary focus of the meeting was the presentation of an amended housing plan by Dan Leven of Acuity Consulting Services. This plan was revised following a challenge from the Fair Share Housing Center, which led to mediation overseen by special adjudicator Beth McManis and Judge Mary Jacobson. The amended plan removed a previously utilized vacant land adjustment, which had determined the borough’s obligation for 240 units, due to a lack of available vacant land. Instead, the borough opted to meet this obligation through redevelopment efforts alone. This strategic shift included the removal of the previously unsuccessful accessory apartment program, replaced by new compliance mechanisms aimed at facilitating higher-density development in designated transit village areas.
Leven detailed specific redevelopment areas, such as a planned 60-unit development on Ernston Road with a 20% affordable housing set aside, which promised a more feasible approach to fulfilling the housing obligation. The plan also included an expansion at the Gillette Tower site and credits from a newly established special needs facility. Board members inquired about the exact locations of these transit villages, emphasizing the importance of location in relation to known landmarks.
The meeting took a contentious turn with a public comment from James Burns, a representative of a property on Washington Road, known as the former Rite Aid site. Burns, along with Tyler Prime from Spotless Flagship, argued that the site, a uniquely shaped triangular plot, was unsuitable for residential development and should be excluded from the borough’s redevelopment plan. They emphasized that the site is leased for a car wash conversion and conforms to current zoning regulations. Concerns were raised about potential future implications if the property were included in housing plans, particularly regarding possible condemnation scenarios.
Board members deliberated on the impact of excluding the Rite Aid site from the housing plan, noting its negligible effect, given the borough’s surplus of 37 units over the required 240. They discussed whether such an exclusion would necessitate further negotiations with the fair share mediator.
The board acknowledged the challenges posed by the trust fund’s use for acquiring affordable housing credits, citing the prohibitive costs associated with subsidies and the reluctance of landlords to commit to long-term deed restrictions. The feasibility of such an approach was deemed highly challenging due to these factors.
As the meeting progressed, the board expressed a consensus toward adopting the amended housing plan while recognizing the objections concerning the Rite Aid property. The resolution, intended to align with the master plan’s goals and promote public welfare, was approved unanimously. The board also discussed administrative matters, including the cancellation of the next meeting due to a lack of agenda items.
