Titusville Code Enforcement Board Recommends Lien Reduction for Compliance Efforts at Miriam Drive Property

The magistrate acknowledged Sarco’s efforts, noting the principle of buyer beware in foreclosure situations but also expressing a need for fairness. Despite Sarco’s awareness of potential issues, the extent and costs associated with them were not fully realized until after acquisition. The magistrate recommended reducing the lien to $21,450, a figure inclusive of all costs incurred by the city, while maintaining the importance of Sarco’s prompt corrective actions. This recommendation is set to be forwarded to the city council for approval, where Sarco will have the opportunity to participate in discussions.
In another case, the board turned its attention to 218 Ojiway Avenue, which had faced violations concerning an accessory structure, specifically a fence and a swimming pool enclosure. The property had been under scrutiny since January 12, with tenants receiving eviction notices and compliance deadlines looming. By March 5, repairs were completed, including fixing the fence, though the pool was deemed irreparable but not hazardous. The city confirmed compliance, and no fines were imposed given the complexities of the case.
The meetings continued with discussions on property on Thorough Street, where significant violations remained unaddressed despite some progress. The absence of the respondents, BAF Asset 6 LLC and Corporation Service Corporation, coupled with the city’s insistence on permanent repairs, led to fines of $100 per day for each of the five outstanding violations, effective from March 7.
The board also reviewed a case involving unauthorized tree removal on Clover Lane. The property owners, Michael Trip and Melvin and Marian Zimmerman, faced fines for removing a pine tree without the necessary permit. Trip explained that the removal was due to safety concerns related to sinkholes and compromised roots. Despite their contention of acting on advice from an arborist and park management, the board imposed a reduced fine of $1,000, acknowledging the situation’s complexity.
Mark Howell, owner of the property on Apollo Road, was granted a three-month extension to submit a permit application for either rehabilitation or demolition. The board emphasized the need for timely action, setting a compliance deadline of June 5, 2026, with fines of $100 per day for any continued violations.
The meeting further addressed a property referred to as the “cat house” on Golf View Drive, imposing a $100 daily fine per violation due to ongoing issues despite the previous occupant’s departure. Additionally, the board discussed compliance on Tina Circle, now in order but with unpaid costs potentially leading to a lien, and Byron Avenue, where estate complications delayed necessary actions.
