Fall River Planning Board Tackles Spring Street Project and Drainage Challenges

Aguar stressed the importance of ensuring all documentation and legal rights for construction are filed correctly, emphasizing the differentiation between ownership rights and the right to build. The drainage calculations emerged as a concern, as all drainage from the Tiverton land would flow into Fall River. Smith committed to providing necessary calculations for the soil conditions and sizing of infiltration catch basins in accordance with stormwater management regulations.
The discussions revealed that some work appeared to have been done in the area without proper permits or erosion controls, raising compliance concerns. Aguar highlighted the need for a review of recent work near the proposed Spring Street right-of-way. The Board awaits comments from the community utilities department, focusing primarily on drainage and stormwater management.
In parallel, the Board deliberated on a proposed development on Balduk Lane. Concerns were raised about drainage, utility placement, and the potential for future development. Aerial photographs illustrated ongoing work, prompting a discussion about addressing potential drainage issues and ensuring compliance with local ordinances. Recommendations for underground utilities and lighting were made, given the narrowness of the proposed road.
The Board members expressed concern about the potential for additional homes and the adequacy of infrastructure to support such developments. The developers were urged to present a master plan outlining future projects and the implications on infrastructure. The need for effective stormwater management on the Rhode Island side, where rain gardens and infiltration systems would be required, was also discussed.

Other applications involved subdivisions that required the Board’s endorsement, such as JV Whipple Residences LLC’s plan to subdivide a property on Whipple Street, and Broen Properties LLC’s proposal for a single-family dwelling on Russell Broen Boulevard. The Board also discussed Palumbo Properties Inc.’s application to merge several parcels on Pleasant Street into two lots. Each proposal was scrutinized for compliance with zoning approvals, with motions to endorse each plan passing unanimously.
Additionally, a waterways license application from Captain Joseph J. O’Connell Company, Inc. was reviewed. This application involved constructing floats and docks along the Taunton River, with prior approval from the conservation commission and no landward improvements planned.
