She recounted distressing events such as her mailbox being removed and a brass screw posing a hazard to her vehicle. Despite these hardships, the magistrate focused on the need for compliance, emphasizing the financial implications of the daily fines and the potential for a lien against the property if the violations were not rectified.

Al Prince testified, committing to addressing the issues and stating, “We in the process. Give us two weeks. We will have that thing done.” He outlined a plan to clean up the backyard, which was a primary concern, and assured compliance with city regulations. The magistrate granted an extension until May 6 for the cleanup, noting that fines would continue to accrue until compliance was confirmed. A follow-up hearing was scheduled for May 27 to evaluate progress, with the magistrate stressing the need for a reinspection once the cleanup was complete.

Another matter discussed was the issue of business tax compliance. Deputy city clerk Jody Lindberg presented testimony regarding the failure of certain businesses to pay the required local business tax. Notices were sent out to approximately 3,050 businesses, with reminders issued via email and phone calls. The businesses “Level of Fitness LLC” and “Echo Salon” were noted for their delinquency but ultimately achieved compliance before the hearing, having settled their dues, including penalties and late fees totaling $349.

The magistrate explored the potential for additional assessments for repeat violations but found no provisions for this within the existing statute or city code, aside from the $250 penalty and established legal process.

Lastly, the hearing addressed a building permit violation by Derek Benson, who had constructed an accessory structure without authorization on First Street South. The structure exceeded the 35-foot height limit, and the building official determined that removal was the only option. Benson, unable to attend the meeting, communicated through representatives his intention to hire a contractor to remove the non-compliant portion of the structure within two weeks. The magistrate scheduled a follow-up on May 27 to verify compliance with the removal directive.
