As per Florida statutes, a dissolved corporation can only wind up its affairs and cannot engage in active business operations. The commission, following legal counsel’s advice, decided that they could not proceed with the application due to the dissolved status of the LLC. Consequently, the public hearing was closed, with plans to renotice the matter for a future meeting once the applicant rectified their corporate status.
This legal hurdle was not the only issue discussed. Noise and traffic concerns were prevalent topics during the public hearing. Residents voiced worries about the potential disruption caused by the expansion, particularly the noise associated with pickleball courts. One resident, Darby Stevens, highlighted the “constant loud popping sound” from pickleball games and the social noise from crowded courts. The proposed courts were to be located approximately 43 feet from her property line, exacerbating concerns about the impact on her quality of life. Suggestions were made to impose restrictions on playing hours and to consider quieter paddles and balls to mitigate noise.
Traffic was another significant concern, with an estimated 555 average daily trips expected upon project completion. This figure was significant for Fifth Place Southwest, a small residential street, and raised alarms about altering the character of the neighborhood. The project, once completed, would introduce more sports courts than any existing county regional parks, further intensifying traffic concerns.
Despite these concerns, there was support for the project’s potential to revive the club and improve the site. A member of the public expressed support for the project, citing the deterioration of the existing facility and the community’s fond memories associated with the club. However, apprehensions about the project’s intensity and potential detriment to the community remained unresolved.
The commission members deliberated on whether to approve a special exception for a non-active corporation. They discussed the implications of the applicant’s legal status, considering future procedural norms to ensure that applicants maintain active corporate status before submitting applications. Ultimately, a motion was made to continue the application until the corporation’s status was resolved, allowing the board to hear evidence at that time. The motion was supported by the board, emphasizing the need to address the applicant’s legal standing before further proceedings.
