North Miami Board Approves Variance for Check-Cashing Store Despite Staff Recommendation
- Meeting Overview:
The North Miami Board of Adjustment convened on May 20th to deliberate on a contentious variance request by Amscott Corporation, seeking permission to open a check-cashing store within 1,500 feet of a residential area. Despite a staff recommendation to deny the request, citing non-compliance with five of six required standards, the Board approved the variance after a heated discussion, acknowledging the community’s need for financial services.
Amscott Corporation’s request for a variance was the central focus of the meeting. The proposed location at 815-817 Northwest 119th Street is a commercial district adjacent to a residential neighborhood, necessitating a variance due to its proximity to homes. Daniel Lozander, the zoning administrator, presented the staff’s analysis, which recommended denying the application because the applicant met only one of the six standards required for approval. Despite this, the Board ultimately decided in favor of Amscott, citing the potential benefits of filling a long-vacant property and providing financial services to underserved residents.
Arthur Sord III, representing Amscott, argued for the variance by emphasizing the existing commercial nature of the property and the minimal disruption the store would cause. He highlighted Amscott’s broad range of services, including money orders and bill payments, and pointed out that the company had received support from local businesses. Sord contended that the 1,500-foot restriction imposed undue hardship on potential tenants due to the commercial corridor’s proximity to residential zones.
Daphne Hardman, a nearby resident, opposed the variance during the public hearing. Hardman expressed concerns about the predatory nature of check-cashing businesses and their impact on financially vulnerable individuals. She highlighted the presence of traditional banks in the vicinity, questioning the necessity of a check-cashing store. Additionally, Hardman raised issues about the potential increase in transient foot traffic and the security of deposits without FDIC insurance. Her concerns about ongoing construction damaging a wall between her property and the proposed site underscored her skepticism about the store’s community contributions.
One board member acknowledged the valid points regarding predatory lending but argued that the store would provide access to funds for those who might not qualify for traditional banking. Another member expressed caution about granting variances when other commercial uses could occupy the site without requiring special permission, yet ultimately supported the variance due to the existing structure and community needs.
Questions about the store’s operational hours were clarified, with confirmation that it would operate from 7:00 a.m. to 11:00 p.m. daily. The Board deemed this schedule acceptable, noting that noise regulations would address any late-night disturbances. The discussion also touched on improving the aesthetics of the surrounding area.
In addition to the variance decision, the Board addressed leadership changes due to a vacancy. Michael Mcierade was elected as the new chair, with discussions about electing a new Vice Chair postponed until the next meeting.
