Jackson Zoning Board Approves Variance for Undersized Lot Development on Harmony Road

To achieve this, several variances were necessary due to the property’s dimensions: the lot area of 40,008 square feet is below the 130,000 square feet requirement, and the lot width of 129.35 feet does not meet the 200 feet standard. Additionally, the proposed side setbacks are 31 feet, less than the necessary 50 feet.
The board heard detailed arguments from the project’s engineer and planner, Mr. Intile, who described the lot as an open pine forest without wetlands and noted that the front setback complies with regulations. Intile emphasized that the project would not be overbuilt, assuring the board that significant trees and open spaces would be preserved. He also compared the proposed setbacks to neighboring properties.
Concerns were raised about the potential impact of the development on the neighborhood, particularly regarding stormwater management and the use of attic and basement spaces. The applicants assured the board that the attic, although offering potential for future use, currently has no specific plans for habitation, and the basement would remain solely for storage or recreational purposes without living accommodations. They committed to installing a dry well for stormwater management and consulting with township officials to ensure compliance with engineering and zoning standards.
A board member highlighted the importance of maintaining neighborhood standards while accommodating the applicant’s needs, noting that leaving the lot vacant was not ideal. The discussion included a review of the lot’s history, revealing that it was part of a subdivision approved in 1990, which resulted in its current size. The applicants had previously attempted to acquire additional land to meet zoning requirements but received only one response from neighboring property owners, showing a lack of interest in selling additional land.
As deliberations continued, the board considered the implications of the architectural plans and the size of the proposed structure. A consensus emerged that the development was in line with the neighborhood’s character, despite the lot’s non-compliance with current zoning standards. The proposed home’s size, just under 3,000 square feet, was deemed appropriate for the area, and the architectural design was viewed as a positive aesthetic addition to replace the vacant, overgrown lot.
Ultimately, the board voted unanimously to approve the application, with board members expressing that the variances were reasonable given the unique circumstances of the property.
