The staff underscored that the deviation was essential to protect these graves and trees, and that the proposed aluminum fence would be in harmony with existing fences in the area. The plan included planting a large canopy tree from a Florida-friendly list to enhance aesthetics and provide shade. The recommendation for approval was conditional on this planting.
Following a presentation and discussion, which included clarifying the fence’s distance from the pavement, the board agreed with the staff’s recommendation. A motion to approve the deviation was made and seconded, with the board unanimously voting in favor.
The meeting also addressed changes to the special event permit regulations, with ordinance number 1767 proposing amendments to clarify when such permits are needed. The ordinance intended to allow monthly special events at places of worship, reducing the maximum duration from 14 to 3 days, aligning with existing land development code definitions. This shift aimed to prevent event organizers from circumventing regulations by altering event names and to accommodate frequent events on church properties.
During discussions, concerns were raised about potential unregulated large gatherings. The staff clarified that any event anticipated to draw over 200 attendees, even on church property, would require a special event permit to manage impacts on city services, traffic, and parking.
The ordinance also sought to categorize farmers markets as special events, allowing them to occur once a month for three days, providing flexibility for various events, especially at larger venues like shopping malls. This change was intended to address the practice of changing event names to comply with existing rules.
A participant inquired about the exemption status for places of worship, confirming that as long as events are organized by and held on properties owned by places of worship, they remain exempt from needing a special event permit, provided they don’t require city services. The staff explained that the code is designed to manage city impacts and that events necessitating police presence due to their size would still require permits.
The board unanimously approved the ordinance, recommending it for adoption, with plans for presentation at upcoming city council public hearings. The meeting concluded with a brief mention of future meetings scheduled for June 2 and June 16, with no confirmed agenda items.
