Southwick Conservation Commission Approves New Residential Development with Stormwater Management Plan

The Commission discussed long-term maintenance of the stormwater system, which would be overseen by a homeowners’ association. This prompted concerns about the timely establishment of such associations, as well as the potential for encroachment into the vegetated wetland by future homeowners.
The Commission agreed on setting a bond at $15,000 to ensure compliance and maintenance. It was also decided that markers should be installed along the 50-foot wetland buffer zone to prevent future encroachment. With these conditions in place, the project received the Commission’s approval.
Following the decision on South Lumis Street, the Commission addressed a Request for Determination of Applicability (RDA) for a landscaping project on Depot. This involved constructing a 95-foot stone wall within the riverfront area. The wall, which would maintain the historical character of the property, was approved with minimal impact anticipated on the riverfront. Conditions included installing straw waddles to control erosion. The project received a negative determination.
The Commission also examined a dock permit dispute involving lots 61 and 170. The owner of lot 61 claimed deeded lake access, but their dock, used since 1982, was deemed illegal due to the absence of a licensing application. The owner of lot 170, a recently constructed property, denied the request to reinstall the dock, highlighting a complex dispute over lake access rights. The Lakes Management Committee asserted that access did not automatically confer dock rights.
In addition to these discussions, the Commission reviewed projects related to conservation and wildlife management. Erosion control measures were highlighted for the North Pond Conservation Area, with recommendations to use straw waddles and logs to mitigate water flow and soil erosion. The Commission approved a project involving erosion control and planting plans across three phases at another site, pending state comments.
The Commission also touched on administrative matters, including appointments to the open space land management and recreation planning committees. The importance of filling these roles was emphasized to ensure effective land management strategies. Maintenance concerns, such as trash removal from conservation properties, were addressed, with a budget allocated to hire seasonal workers. The ongoing issue of dock usage in Turtle Cove was also briefly discussed, with discrepancies over permissions noted.
