Cocoa Beach Special Magistrate Debates Extension for Yacht Club Permits
- Meeting Overview:
The Cocoa Beach Special Magistrate meeting on June 10th concentrated on deliberations over a contentious extension request tied to the Coconut Cove Yacht Club’s permit issues. The meeting, led by Special Magistrate Lonnie Groot, addressed complex compliance matters related to unpermitted construction and unresolved permit applications, bringing to light ongoing disputes between the property owner and city officials.
The focal point of the meeting revolved around case DSC25-54, concerning the Coconut Cove Yacht Club. The core issue involved the property’s failure to secure necessary permits for a parking lot and an accessory structure. Daniel Crawford, a witness for the city, detailed the property’s compliance history, noting that while the accessory structure had been removed, the parking lot remained non-compliant due to piles of asphalt debris. These piles were classified as construction debris and needed removal to meet city code requirements.
Crawford described the series of events leading up to the current situation. After a February hearing, the property owner, Mr. Betazil, was ordered to secure permits within specified timelines. Although Mr. Betazil made efforts, including the removal of some unpermitted structures and debris, the remaining issues were compounded by complications in the permitting process and communication challenges with city officials.
A significant portion of the discussion centered on the status of two permit applications, PZ2319 and BP237, which were described as incomplete by city officials. These applications, although submitted, lacked the necessary information for approval. The city maintained that without complete submissions, the permits could not be issued, and the existing applications were considered pending rather than active.
The property owner’s attorney, Jason Gordon, argued that excessive correspondence and difficulties with tenants and contractors had hindered compliance efforts. He claimed that the city’s communication regarding the permit statuses was unclear, contributing to the ongoing issues. Gordon contended that despite these challenges, the property owner had been proactive in addressing the requirements, though he conceded that the engineer’s recent departure had further complicated matters.
The city’s representatives firmly opposed the extension request, emphasizing a long-standing pattern of non-compliance dating back several years. They argued that granting an extension would not resolve the fundamental issues, which included a lack of due diligence in adhering to the city’s permitting procedures. The city officials stressed the need for the property owner to meet compliance requirements that had been clearly outlined multiple times.
As the debate unfolded, the magistrate sought to clarify procedural aspects, highlighting that while the extension request was being denied, the matter would be revisited at a scheduled Massie hearing on July 7th. It was noted that denying the extension would not immediately result in penalties, with potential fines not being considered until after the hearing.
In the interim, both parties expressed a willingness to continue discussions to seek resolution, acknowledging the importance of addressing the issues comprehensively. The magistrate underscored the procedural steps that would follow, allowing for further examination of the extension request and associated compliance matters during the upcoming hearing.
