Brevard County Planning Board Denies Zoning Change for Gas Station Near School

The proposal, submitted by Sammy and Violet Salib, sought to amend the future land use from Neighborhood Commercial (NC) to Residential 2 (RES 2) and change the zoning from Agricultural Use (AU) to Business Use 1 (BU1). This would allow for the construction of a gas station and a small retail service establishment. Carmine Ferraro, representing the applicants, presented the case for the change, but it quickly became apparent that the community was divided.
Donald Clark, a nearby business owner, supported the proposal, arguing that it would bring economic growth to the area. However, the most vocal opposition came from James Kersner, who was particularly concerned about the safety implications for the nearby Pinewood Elementary School. Kersner highlighted the risks posed by increased traffic and the presence of commercial vehicles near the school, emphasizing the need to keep the area safe for children. Audience members echoed these sentiments, worried about the potential for accidents and environmental impacts from the gas station.
Despite the applicants’ assurances and the potential economic benefits, the board took the community’s apprehensions seriously. After a thorough discussion, the board members voted unanimously to deny the applications for both the land use and zoning changes. The decision was met with approval from the concerned residents present at the meeting.
Another zoning discussion involved a proposed change from Agricultural Use (AU) to Business Use 1 (BU1) for a property on L Road. The proposal faced staunch opposition from local residents, including William Gondridge, who was adamant about preserving the rural character of the area. Gondridge expressed his concern that a commercial development would obstruct views and decrease property values, arguing that the agricultural zoning aligned with the community’s rural lifestyle.
In contrast, James Bargeron supported the property owner’s right to utilize their land as they saw fit. Environmental concerns were also raised by Angie Banks, who worried about potential contamination of local water supplies, as most residents relied on wells. The board, after weighing these concerns, was inclined to deny the rezoning request, emphasizing the speculative nature of the proposed development and the potential adverse effects on the community.
The meeting also addressed a request from Anthony Palonga, who sought to rezone his two-acre property from Agricultural Use (AU) to Rural Residential (RR1). Palonga explained that due to the county’s zoning requirements, his property was no longer compatible with agricultural zoning, which requires a minimum of two and a half acres. Supporting Palonga’s request, Mary Hillberg highlighted the compatibility of the proposed change with the surrounding rural residential areas. After a lengthy discussion on access and easements, the board approved Palonga’s request unanimously, allowing him to move forward with his development plans.
Another notable item was the proposal from BT Roads LLC and Padet Properties Trust for a small-scale comprehensive plan amendment. The zoning classification change from BU-1A and AU to BU-2 was intended to support local commercial growth. Despite concerns regarding the potential for future multifamily developments, the board approved the zoning change with a binding development plan (BDP) to restrict certain uses.
The session concluded with a few more zoning requests, including a request from AB RS LLC to change the zoning classification to enable the development of mini storage facilities. Meanwhile, a proposal from the Jean A. Benson and Arthur W. Berger Jr. Trust was withdrawn after receiving negative feedback, highlighting the board’s responsiveness to community sentiment.
