Fall River Zoning Board Approves Variance Amidst Parking and Development Debates

Another highlight of the meeting was the board’s decision on a variance request by Seth D. Eli and Lisa Eli to add onto their single-family dwelling on Watkins Street. The proposed addition required a variance for side yard setbacks due to the property’s unique shape. The addition aimed to accommodate a family member, and while the board expressed concerns about potential future misuse, they unanimously approved the variance.
The board also reviewed a proposal from Dylan Estates on the River LLC, which involved demolishing a three-family structure to build a five-story, 12-unit apartment building. This application required several waivers, including those for yard setbacks and lot coverage, due to the property’s challenging shape and the zoning requirements near the waterfront. The board scrutinized the density of the proposed development and the necessity of the variances, ultimately questioning if a smaller project could adhere to existing zoning laws without waivers.
Parking waivers were another point of contention. The board granted a special permit for 422 Street LLC to convert a former storefront into an accessory dwelling unit (ADU), despite concerns about the lack of off-street parking. The property, already part of a six-family dwelling with no parking, would have required 13 spaces if the ADU were added. The board debated the implications of setting a precedent by waiving parking requirements, ultimately deciding in favor of the petition, but not without a dissenting vote that highlighted ongoing concerns about neighborhood congestion and future planning.
The meeting also addressed a proposal from the Steven T. Gomes Living Trust to subdivide a property into two lots, each containing an existing three-family dwelling, in a single-family zoning district. The applicant argued this would enhance affordability and increase the city’s tax base. The board approved the special permit with conditions related to utility separation and site plan review, emphasizing the importance of careful neighborhood integration.
Finally, the board approved a variance for a medical spa to offer cosmetic tattooing services, despite discussions about parking adequacy. The spa, which operates by appointment, shares parking with other tenants. While the variance was granted, the board’s dialogue reflected ongoing concerns about parking sufficiency, especially if property ownership changes.
