Port Richey Board Considers Increased Density and Airbnb Regulations Amid Community Concerns
- Meeting Overview:
In a recent meeting, the Port Richey Planning and Zoning Board discussed potential changes to local zoning regulations, including an amendment to increase the allowable density for planned unit developments (PUDs) and the need for zoning regulations on short-term rentals like Airbnbs.
A significant portion of the meeting centered on the proposed zoning text amendment to section 127-58 regarding PUD zoning districts. The city planner detailed that the current regulations cap dwelling units at 18 per acre, while the comprehensive plan allows for up to 40 units per acre under the Cody River Landing future land use category. This discrepancy necessitated a revision to ensure consistency and better accommodate modern building practices. The proposed changes included an increase in the maximum building height from 72 feet to 85 feet, which sparked debate among board members. Concerns were raised about the impact of taller buildings on areas not equipped for such developments, though it was noted that the city council could impose lower height limits as required by specific project contexts.
The board’s discussion also addressed the calculation of open space requirements, proposing that only upland portions of a site be considered, thereby excluding submerged lands. This change aims to create a fairer assessment, particularly for waterfront developments, while recognizing public amenities like boardwalks as open spaces. The minimum parcel size for PUD applications would remain at five acres, with the possibility of city council-approved exceptions for projects that align with community goals.
The meeting also tackled the increasingly contentious issue of Airbnbs operating in residential neighborhoods. Concerns were voiced about the lack of zoning regulations for short-term rentals, with board members advocating for a distinct zoning classification that recognizes these properties as quasi-commercial entities. The board acknowledged the potential for increased income from regulating such rentals and the necessity of implementing controls to mitigate their impact on the community.
Additionally, the board considered an amendment to the land development code concerning the parking and storage of recreational vehicles (RVs), boats, and similar equipment in residential areas. The proposed changes to section 127-92 included allowing temporary driveway parking for RVs for up to 72 hours and reinforcing prohibitions against parking in required front yards or between a public right-of-way and a body of water. The amendment aimed to balance residents’ practical needs with neighborhood compatibility and code enforceability. A detailed overview of these changes noted the need for maintaining equipment operability and registration, as well as existing provisions for temporary RV parking after disasters.
The board’s deliberations extended to the definitions and classifications of major recreational equipment, particularly concerning the storage of boats and watercraft. Concerns were raised about existing code language that might inadvertently restrict property owners with lot segments divided by a road. Participants debated the interpretation of “front yard” when a road separates a home from its waterfront property and the implications for parking regulations. Suggestions were made to revise the language to better reflect state statutes and prevent loopholes, with the intent to streamline enforcement processes.
The proposed zoning text amendments aim to promote public health, safety, and welfare. The board plans to continue discussions and further examine the proposed amendments in light of community concerns and Florida statutes, with the next meeting scheduled for August 20th.
