Acushnet Conservation Commission Deliberates on Wetland Buffer Zones and Environmental Compliance

Another continued public hearing involved MD South Coast Properties LLC’s proposal for constructing three duplex buildings on Middle Road. This project also lies within a 100-foot buffer zone of bordering vegetated wetlands. The representative plans for a retention pond and minor site alterations. A decision was made to delay the hearing until after a site visit scheduled for April 26, 2026, allowing members to assess the property firsthand. The motion to continue was unanimously approved.
In other business, the commission reviewed a request for an extension of an existing order of resource area delineation for a photovoltaic solar farm project by TJA 540R Main Street. Delays in utility interconnection studies prompted the request. The applicant’s representative noted that site conditions remained unchanged since the original delineation and that wetland flags had been refreshed in January 2026. However, members raised concerns about the delineation plan referencing a 2026 date instead of the original 2018 date and the absence of numbered wetland flags during a recent site visit. The commission discussed the possibility of a peer review to ensure the delineation’s accuracy, ultimately agreeing to pursue this step.
The meeting also addressed a Notice of Intent filed for a property on Elderberry Drive, where the applicant proposed replacing an existing garage with an accessory dwelling unit. The work would occur outside bordering vegetated wetlands and primarily within upland areas. The commission attached special conditions to the order of conditions, including erosion control measures and compliance deadlines, and accepted the proposal without significant complications.
A stormwater permit review related to a homeowners association for a development on Angelo Drive was discussed. The transition of stormwater maintenance responsibility to a homeowners association was supported, relieving the town of liability while maintaining oversight through a recorded maintenance plan. The commission expressed approval of this approach.
A resident named Alex sought a contingency to proceed with personal construction, conditional on completing and recording the homeowners association plan and stormwater management plan. The commission agreed to allow construction to commence with these contingencies in place.
Additionally, the commission addressed a long-standing complaint concerning 185 Madapoet Road, where a resident faced flooding issues due to improper drainage from a neighboring construction site.
