Amherst Board Delays Decision on Arcade and Bar Proposal Over Concerns of Noise and Underage Drinking
- Meeting Overview:
At its recent meeting, the Amherst Zoning Board of Appeals addressed several matters, highlighted by a proposal to open an arcade and bar on Cows Road, which prompted an extended discussion about potential noise and underage drinking. The board decided to defer a decision on the proposal, seeking further deliberation on the conditions tied to the special permit.
The proposed establishment, the Tilted Orbit Arcade, aims to repurpose a former country market into a gaming and social hub. The arcade would feature a variety of games, including pinball and board games, alongside a bar with a small outdoor patio. The applicant, Amy Mcdana, emphasized a vision of inclusivity, stating her goal to create a space for all ages within the community. However, the board expressed concerns about the potential impact on the surrounding residential area, particularly regarding noise levels and the risk of underage drinking.
Concerns were raised about the suitability of the arcade’s operational hours, which extend until midnight on weekends, potentially increasing evening traffic compared to the market’s earlier closing times. The applicant countered by suggesting that the arcade would primarily shift traffic patterns to later hours rather than increase overall volume.
Public comments highlighted neighborhood concerns, with Hilda Greenbaum from Montague Road voicing apprehensions about noise and disturbances from late-night patrons. She recalled past community resistance to similar proposals, stressing the need for conditions to mitigate potential issues. This sentiment was echoed by board members, who discussed the necessity of noise control measures, particularly given the proximity to family neighborhoods.
To address underage drinking, the applicant proposed a management plan, featuring electronic ID checks and regular monitoring. Only patrons with hand stamps indicating they are over 21 would be served alcohol, and staff would conduct periodic sweeps to ensure compliance. Despite these assurances, the board expressed the need for clearly documented safeguards within the special permit conditions.
The board decided to postpone the decision on the arcade’s special permit to allow more time to refine the conditions. A proposed date of April 9th was set for further discussions, with board members agreeing to review past permits for similar establishments to guide their decision-making.
In another notable agenda item, the board approved a request for a six-month extension on a special permit for a solar energy project on West Palmer Lane. The applicant, Fort River Solar 2 LLC, cited delays caused by the COVID-19 pandemic and winter conditions as reasons for the extension. The board’s approval followed a review of updated plans and compliance with local regulations. The extension allows the applicant additional time to complete battery installation and finalize the project.
Additionally, the board considered a request for a special permit transfer related to a solar project at Pulp Hill. The transfer was granted following confirmation that substantial construction had been completed, meeting the conditions of the original permit. The board noted that safeguards from the initial approval would remain in effect.
