Amherst Zoning Board Approves Removal of Owner Occupancy Requirement for South Prospect Street Property
- Meeting Overview:
The Amherst Zoning Board of Appeals convened to address two matters: the compliance of Valley Community Development Corporation (CDC) with previously set permit conditions and a request to modify a special permit for a property on South Prospect Street. The meeting, held remotely, resulted in the approval of Valley CDC’s compliance efforts and a unanimous decision to remove the owner occupancy requirement for the South Prospect Street property in favor of a resident manager arrangement.
The board’s decision to modify the special permit for a property on South Prospect Street was the most significant outcome of the meeting. The property’s owner sought to replace the longstanding owner occupancy condition, in place since a 1984 special permit, with a requirement for a resident manager to live on-site. This change aligns with section 10.33 of the zoning bylaw, which permits such modifications under specific circumstances.
Attorney Tom Rei, representing the applicant, explained that the change would involve a professional management company, Pipeline Properties. This arrangement intends to maintain orderly property management while the owner is not in residence. A site visit by several board members confirmed the appropriateness of this setup, with Rei asserting, “It’s a good site. It’s appropriate to have this use at that site appropriately managed.”
Throughout the public hearing, board members raised questions about the implications of the modification, particularly concerning the selection process for the resident manager. Assurances were given that candidates would be thoroughly vetted, and undergraduate students would be excluded from consideration. Mr. Meadows inquired about the owner’s timeline for returning to Amherst, to which it was noted that plans were in place for a potential return within three years.
The board also discussed the management dynamics between the resident manager and other tenants, emphasizing the importance of clear communication and issue reporting rather than direct tenant management. Concerns were raised regarding the potential for conflicts when the resident manager is also a tenant, highlighting the need for professional management oversight.
Further deliberation focused on the parking arrangements associated with the property. Mrs. Greenbaum pointed out a discrepancy between observed and documented parking details. It was clarified that two parking spots were designated for the downstairs apartment, while the upstairs unit would rely on street parking, with no additional parking planned for new bedrooms. This clarification was deemed critical for the board’s decision-making process.
The board also addressed the structure of the permit language, particularly the necessity of retaining conditions from the 1984 permit. A legal representative emphasized the importance of referencing the original permit to maintain a clear historical context for enforcement. The consensus was that incorporating conditions from the original permit into the new one would prevent enforcement challenges and maintain continuity.
After extensive discussion, the board unanimously approved the findings related to the permit modification and subsequently voted to approve the request to remove the owner occupancy requirement. This decision allows the property to transition to a resident manager model.
The meeting also touched on Valley CDC’s successful compliance with conditions from a previously granted special permit. Jessica Allen, representing Valley CDC, presented documents fulfilling requirements such as an affirmative fair marketing plan for income-eligible first-time homebuyers and final drafts of condo documents. The board expressed gratitude for the clarity and information provided, resulting in a unanimous vote to approve Valley CDC’s efforts.
