- Meeting Overview:
The Amherst Zoning Board of Appeals meeting, conducted remotely, focused on the comprehensive permit process under the 40B statute, affordable housing requirements, and the approval of several new development projects. The meeting included discussions about the complexities associated with balancing local zoning regulations with the demand for affordable housing.
Town Counsel Carolyn Murray presented an overview of the 40B comprehensive permit process, emphasizing its unique nature that allows the Zoning Board of Appeals (ZBA) to act in place of other local boards. Murray highlighted the importance of understanding “safe harbors,” which permit towns to limit affordable housing projects if specific thresholds are met. Amherst, having exceeded the 10% threshold, enjoys safe harbor status, allowing it to deny certain comprehensive permits, although this decision can be appealed to the Housing Appeals Committee.
Murray explained that developers often seek greater density under the 40B statute to offset costs associated with affordable housing projects. This can challenge local zoning practices, as the statute prioritizes affordable housing development. The term “consistent with local needs” is crucial in evaluating comprehensive permits, meaning any local rule must be based on public health and safety while aligning with the overarching goal of increasing affordable housing.
The meeting also addressed the procedural aspects of the 40B process, including timelines for filing decisions, the necessity for public hearings, and the ability for developers to file waiver lists seeking exemptions from local bylaws. The ZBA’s vote on comprehensive permits requires a simple majority, differentiating it from other voting procedures. The board can impose conditions on approvals, but developers may contest these if they believe they make the project economically impractical.
A significant portion of the meeting was dedicated to discussing a proposal to convert a property on North Pleasant Street from a lodge to a social dormitory. The proposal, presented by an attorney representing Amst Development Associates, aimed to change the property’s use from transient lodging to a more stable residential environment with 16 units and an anticipated occupancy of 17 beds. The board scrutinized the management plan, parking arrangements, and the overall impact on the neighborhood.
Questions arose about the student residency requirements and how the University of Massachusetts would enforce them. Concerns included how to handle students who might lose their enrollment status mid-lease and the implications for eviction processes. The board also discussed the lighting conditions surrounding the property, emphasizing the need for compliance with dark sky regulations to prevent light pollution and enhance safety.
Further discussions involved waste container placement, the potential need for electric vehicle (EV) charging stations, and ensuring that renovations, such as new doors and windows, meet safety standards. The board expressed a desire for clear documentation on these aspects and a commitment to maintaining a well-kept landscape around the property.
The meeting also considered the management plan for a property on Hazel Avenue. The applicant requested a special permit to convert the property into a multi-unit rental with three residential units. The board reviewed the management plan, noting that the applicant had made amendments, including clarifying that he and his wife would act as property managers. This discussion concluded with a unanimous vote to approve the amended management plan.
The importance of coordination between the ZBA and other town boards, particularly regarding projects involving wetlands and the Conservation Commission, was highlighted.
