Council members were divided on the matter. One member explained that the appeal was filed to meet a deadline, and the council could still withdraw it. They highlighted the complexities and necessity of addressing safety issues, stating, “if our attorney is correct… I think unfortunately for the people involved it’s worth the try.” Another council member stressed the importance of continuing the remediation process to ensure community safety, citing concerns over contamination and the potential for rare cancers linked to the site. They stated, “if that remediation were to pause again… the only way that we could apply for state grants… is if we went through these steps.”
In another discussion, the Fire Chief raised concerns about the increasing number of fire pits on residential rooftops, describing them as potential safety hazards. He noted two recent false alarms caused by rooftop fire pits and emphasized the community’s reaction to visible flames, which leads to unnecessary dispatches. The Fire Chief proposed studying the frequency of such incidents and referenced the Uniform Fire Code, which mandates that fire pits be at least 25 feet away from structures. He suggested that the town might need to consider ordinances to mitigate these hazards, acknowledging the inherent dangers of rooftop fire pits.
The council also reviewed several ordinances, including Ordinance 2024-27C, which aimed to amend various code chapters. This ordinance was tabled for further review to ensure accuracy and compliance with zoning definitions and requirements for duplexes and outdoor dining. Ordinance 2024-28C, requiring temporary electric poles on construction sites and proper disposal of construction materials, was approved without public comments. Ordinance 2024-29C, which introduced regulations for private storm drain inlet retrofitting as mandated by the New Jersey Department of Environmental Protection, also passed unanimously.
Another ordinance, 2024-30C, sought to prohibit parking on the north side of Second Street during specified hours to alleviate traffic congestion. A council member emphasized the necessity of this ordinance due to obstructive parking reported by residents, and it was approved unanimously. Ordinance 2024-32C aimed to increase fees for beach badges to fund improvements without imposing a tax burden on residents. The council discussed survey responses indicating a desire for better beach conditions and approved the ordinance with a consensus.
Public comments included inquiries about the financial aspects of legal fees related to Beach Haven Auto. Resident Deb Witcraft requested the total amount spent and raised concerns about potential soil contamination from an adjacent incinerator property. Another resident, Jerome McCartland, questioned the ordinance concerning parking on Second Street. The council clarified that these spots would be available for public parking after 4 PM and noted resident support for this change.
The meeting also touched on various community events. Captain Fer of the local fire department announced an upcoming open house at the firehouse on October 12th and expressed gratitude for the council’s support. Discussions clarified that the Chowder Cook-Off, sponsored by the Beach Haven Chamber of Commerce and the Hunger Foundation, would proceed as planned, with at least ten restaurants participating. Attendees will be allowed to bring beer to the event, a change from previous restrictions. The meeting concluded with birthday wishes for the Chief of Police and a motion to adjourn.
