- Meeting Overview:
In the most recent Biscayne Park Code Compliance Board meeting, discussions centered on several property violations, with a focus on driveway infractions and the urgency to resolve them. The board addressed non-compliance issues, debating the importance of adhering to design and material regulations, and set strict deadlines for property owners to follow, along with hefty fines for non-compliance. Notably, one property owner was given until August 19th to obtain a construction permit for a fence, facing a $250 daily fine if failing to comply.
The meeting opened with the most issue concerning a driveway violation at 11345 Northeast 9th Court. The property owner was grappling with the challenge of bringing the driveway into compliance following a lack of a permit and an outstanding fine. Gage Hardung, the Planning and Zoning Design Review Board chairman, provided crucial testimony about ribbon driveways, stating that concrete ribbon driveways are considered an approved parking surface, provided the wheels are parked on the concrete, and emphasized the need for a unified design. The board decided to table this case until August, allowing the property owner time to apply for a permit.
Another topic was the property on Northeast 118th Street, which had been sold, and the new owner had yet to communicate with the board. With no permits for driveway-related violations, the board ordered fines to be imposed if compliance was not achieved by a specified date.
In addition to driveway issues, the board also took decisive action on a property that had been renting without a permit. The case was resolved after the owner obtained the necessary permit and paid the fines, which led to the board closing the case.
A different property owner discussed challenges with a driveway on Northeast 115th Street, including complications with a storm drain installed by the village. The board demonstrated understanding by tabling this case until the August hearing to allow for progress and updates on the situation.
The board also advised a property owner dealing with exterior paint violation to apply for a construction fence permit and have it installed by the deadline, emphasizing the importance of following timelines and obtaining required permits. The necessity for a construction fence at a property located on Northeast 111th Street was debated, resulting in the board passing a motion to assess fines and administrative costs, as well as a daily fine if the fence was not installed by the determined date.
Further discussions included concerns over the accuracy of meeting minutes and the handling of cases carried over from previous meetings.
One case was dismissed due to the property owner securing a new construction permit that included the driveway.
