Biscayne Park Board Imposes Heavy Fines Amid Safety Concerns Over Unsecured Pool
- Meeting Overview:
During the recent Biscayne Park Code Compliance Board meeting, members tackled pressing safety issues and substantial fines related to non-compliance with local ordinances. The board’s primary focus was on a property with an unsecured swimming pool, which posed a significant safety hazard due to a large hole in the surrounding fence. The situation was deemed urgent as the pool could attract children, presenting a potential drowning risk. The board emphasized the community’s past incidents of drowning to underline the severity of the threat.
The board considered whether the violation was of an irreparable or irreversible nature, which would allow fines exceeding the standard $250. A member expressed the need for immediate action. The proposal involved authorizing the village manager to address the issue promptly.
In addition to the pool safety case, the board handled various other compliance issues. A notable case involved a driveway installation on Northeast 114th Street, where fines had accrued to $98,250 due to an expired permit. The board voted to reinstate daily fines retroactively. Similarly, a property owner on Northeast 119th Street faced unresolved fines despite achieving compliance with maintenance orders. The board proposed filing a lien against the property if fines remained unpaid by the stipulated deadline, April 1.
The board also reviewed cases concerning unauthorized property alterations. Hubert Leune, the owner of a property on Northeast 119th Street, faced fines for converting a detached garage into living space without proper permits. Despite vacating tenants, the lack of permits to revert the property led to continued fines and a proposed lien. The board stressed the need for property owners to maintain open communication and compliance with code officers to avoid escalating penalties.
Another case involved a property owner managing a roof condition violation from out of state. The owner, representing an elderly family member, expressed frustration over incomplete contractor work despite financial expenditures. The board, while empathetic to the owner’s situation, insisted on adherence to compliance deadlines, allowing until May 15 to address the violations or face resumed fines.
The board consistently advocated for property owners to engage with compliance processes, emphasizing that cooperation would be considered in future fine assessments.
One item of discussion centered around a property owned by Elan Hami, who requested an extension due to medical hardships. The board acknowledged his circumstances but maintained the necessity for compliance by the newly extended deadline of June 18, 2026, with fines imposed for non-compliance.
The meeting also saw the board handling less urgent but still significant cases, such as a property with a construction dumpster without proper permits. The board imposed fines for non-compliance.
