Biscayne Park Code Compliance Board Considers Changes to Construction Work Hours and Resolves Key Property Violations
- Meeting Overview:
The Biscayne Park Code Compliance Board meeting on December 17th focused on proposed changes to the construction ordinance, aiming to prohibit work on Sundays and federal holidays, while also resolving several property violations involving fines and compliance deadlines.
The most notable discussion revolved around a proposed ordinance change aimed at revising construction work hours. Currently, the ordinance restricts construction on federal holidays to between 11 AM and 5 PM, with no work permitted on Sundays. The proposed changes would completely prohibit construction on Sundays and federal holidays, except for interior work that generates noise confined to enclosed structures. This potential amendment sparked a comprehensive debate among board members about its practical implications.
Concerns were raised over the ordinance’s impact on homeowners, particularly those undertaking do-it-yourself projects. With the proposed restrictions, Saturdays would be the only available day for such work, potentially limiting progress on personal projects for residents unable to afford professional contractors. One board member highlighted this issue, pointing out that typical DIY activities, like building cabinets or working on patios, often produce noise and may not fit within the revised constraints.
The board also discussed the challenges of enforcement, especially with the ordinance’s interplay with noise regulations. There was a worry that noise complaints could lead to increased calls to law enforcement, diverting them from other critical duties during holiday periods. The board debated whether the ordinance should list specific holidays, such as Christmas, New Year’s, and Thanksgiving, to avoid confusion. However, concerns about inclusivity arose, as some members felt this could lead to perceptions of inequity if certain holidays were not recognized.
Despite differing opinions, two out of three members present favored the complete prohibition of construction on federal holidays, while one member dissented. This dissent was rooted in concerns about the fairness of restricting DIY homeowners and potential enforcement complications.
In addition to the ordinance discussion, the board addressed several property violations, with significant fines and compliance deadlines. For instance, the property at 11401 Northeast 8th Court was declared unsafe, with accrued fines totaling $77,500. Florida Power & Light had removed electrical services due to safety concerns. The board moved to file an intent to lien and continue daily fines until demolition, passing the motion unanimously.
Another case involved 11095 Griffin Boulevard, where a fence was installed without proper permits. The property owner, represented by attorney Harry Tempkins, contested the $12,750 fines, proposing a reduction to $500 due to financial constraints. However, the board emphasized the owner’s responsibility to comply with regulations, ultimately agreeing on a $1,000 settlement to be paid by January 21st.
A significant permit issue was discussed regarding a property on Northeast 120th Street, where the roof of a secondary structure had collapsed. The owner, Carl Linder, expressed frustrations over rising demolition costs, now at $20,000, due to code restrictions and utility line relocations quoted at $150,000 by Florida Power & Light. The board set a deadline of January 21st for Linder to obtain a demolition permit, with a daily fine of $250 for non-compliance.
The board also revisited a case involving off-street parking violations at 10:15 Northeast 112th Street, where fines had accumulated to $9,000. The property management was in the process of hiring a contractor to address the issue. The board decided to halt daily fines upon permit application submission, setting a January 21st deadline for the permit, with potential fines resuming if the work was not completed by the permit’s expiration.
In another significant case, Modesto Molina and Sarah Cruz, owners of a property at 11133 Griffin Boulevard, faced parking regulation violations, resulting in $29,000 in fines. The board recognized a communication lapse between departments and recommended waiving the daily fines while maintaining an initial $500 fine, a compromise approved with a 3-0 vote.
Moreover, the board addressed landlord registration compliance, notably with CHGM Holdings LLC on Northeast 117th Street. The property now complied with village regulations, but concerns about multiple homestead exemptions raised issues of potential misuse. The board committed to monitoring such properties and ensuring compliance.
