- Meeting Overview:
During the recent Biscayne Park Code Compliance Board meeting, a focus was on the contested $10,000 charge related to professional services for a hearing before the Miami-Dade County Unsafe Structures Board. Concerns over transparency and documentation were voiced by attorney Matthew Kramer, representing the property owner on Northeast 21st Street. Kramer highlighted the lack of an itemized bill and questioned the reasonableness of the fee, prompting the board to table the case until January for further documentation.
The case on Northeast 21st Street captured the board’s attention due to its financial implications and questions about due process. Kramer, representing the property owner, argued that the $10,000 charge was excessive for preparation related to a 30-minute hearing. He insisted that neither he nor his client had seen an invoice justifying the sum, stating, “a $10,000 fee to prepare for a 30-minute hearing is grossly unreasonable.” Concerns were echoed by board members, who called for more detailed documentation before proceeding with any decision.
In support of Kramer’s position, Caleb Hosing, representing the mortgage servicer, also called for a postponement, citing similar difficulties in obtaining a breakdown of the charges. Hosing commented, “we were not provided a breakdown of this $110,000 added lien,” underscoring the need for transparency in the billing process. The board ultimately decided to delay any action until the next meeting, allowing time for the submission of comprehensive documentation that clearly outlines the charges involved.
The meeting also addressed a range of other code compliance issues. In case number CN24-0064, the board examined violations at 11905 Northeast 12th Court involving unpermitted structures. Testimony from Police Chief Mark Steel revealed safety hazards posed by these structures, which included makeshift living quarters and inadequate safety standards. The board emphasized the necessity of permits for structures to ensure safety and compliance with village regulations.
The board also discussed the matter of a property on Northeast 111th Street, where construction activities commenced outside of permitted hours. The chief of police recounted an incident where demolition work began before 8:00 AM. The board assessed a $250 fine and an administrative fee of $250 against the construction company for these violations, reflecting ongoing issues with adherence to local regulations.
The board debated whether the improvements made to a driveway met the village’s code requirements, concluding that further clarification and potentially another inspection were needed to ensure compliance.
The meeting also touched on procedural matters, such as the handling of compliance-related cases and the scheduling of future board meetings. Discussions on driveway regulations highlighted the need for clearer enforcement guidelines, particularly concerning properties with existing gravel driveways. The board acknowledged the importance of distinguishing between homesteaded and non-homesteaded properties to ensure fair enforcement of codes.
