Video evidence showed an employee putting a patron into a headlock, deemed inappropriate given the circumstances. The board acknowledged the lack of prior context regarding the video, which limited their ability to engage in meaningful dialogue during the hearing. Despite differing interpretations of the video and descriptions provided by involved parties, the board unanimously decided on a violation. This would serve as a first warning for Club Cafe, along with a recommendation for correspondence on de-escalation practices.
Another notable case involved Jan Hung Inc, doing business as New Moon Villa Restaurant, facing allegations of assault and battery involving a dangerous weapon on October 27, 2023. The board decided to defer the hearing until video evidence from the Boston Police is submitted.
Lolita Boston LLC, operating as Lolita Cocina and Tequila Bar, was also under review for a 911 call regarding a medical assist for a female patron on December 7, 2023. After examining the submitted video, the board noted the establishment’s cooperation and determined the incident to be a true accident, with no violation. However, they raised concerns about future documentation for accountability and suggested memorializing discussions in the docket. The establishment had implemented a security lock and signage to prevent similar accidents.
The board also reviewed an incident involving 1732 Center Street Inc, operating as West, where an assault and battery occurred on February 24, 2024. The board found that the staff acted appropriately by separating the parties and calling the police, resulting in no violation. Similarly, Pier 50 LLC, doing business as Committee, faced allegations of an assault and battery with a dangerous weapon on April 14, 2024. The board concluded that the incident was not foreseeable, thus assigning no violation.
In another significant case, Patina Boss LLC, operating as Banners Kitchen and Tap, was found to have a patron under 21 in possession of alcohol on June 6, 2024. The board recognized a violation based on the use of a fake ID and noted that the establishment had already disciplined the responsible employee. Considering no prior violations at this location, the board issued a first warning and emphasized the need for better age checks to prevent alcohol handoffs among young patrons.
The board also addressed overcrowding at A and B Burgers Causeway LLC on June 6, 2024. A violation was identified due to exceeding capacity during a busy event, and management received a warning for failing to control the situation in the absence of a doorman.
Transactional hearings included Virtual Fulfillment Center LLC seeking approval for a common victualler license for a food court concept. The board approved the application, conditioned on maintaining a limited seating capacity of 14. Raising Cane’s Restaurant LLC petitioned to change their closing hours, initially seeking a 2 a.m. closing time but revising it to midnight for indoor service after concerns about security arrangements were raised. The board conditionally approved the change, pending confirmation of security management details.
Baco Fenway LLC and Taco 4 Point LLC both petitioned to change their managers to Anthony Figueroa, which the board approved unanimously, expressing confidence in his character and fitness. Rhubarb Inc sought to transfer their license to Aluson Live Concessions LLC, also requesting updates to the premises description. The board unanimously approved the transfer and description updates.
The board also addressed non-hearing transactions, with Vorel Corporation and My Yogurt LLC both seeking new common victualler licenses, which were approved. Starbucks locations requested to change their capacity to takeout only. Additionally, 30 Fleet Street Corporation and Notch Brighton Tap Room LLC applied for one-day amendments to extend their licenses for specific events, both of which were approved.
In other applications, the BPOE of the United States of America Inc., doing business as Boston Lodge of Elks number 10, requested a one-day amendment to expand their license to include a contiguous parking lot for an outdoor cigar event on September 7th. This request was approved following confirmation from the Boston Public Health Commission. Similarly, Unity Sports and Cultural Club Inc. sought amendments to permit an outdoor parking lot area for a West African Cuisine Festival on multiple dates in August. The board approved the application but stipulated that the license would not be issued until necessary permits were received from the Inspectional Services Department.
