- Meeting Overview:
The Breezy Point Planning & Zoning Commission met on September 10, 2024, to deliberate on several issues, including variance applications for residential developments and a conditional use permit for a community garden fence.
The meeting’s most discussion centered around two variance applications for residential properties on Aspen Lane. The first application, V2410, submitted by BNC Construction LLC, requested a variance for a lot size reduction from the minimum requirement of 16,000 square feet to approximately 15,314 square feet. The property, situated on Lots 82 and 83 of the fourth edition to Breezy Point Estates, is zoned R3 and not serviced by a municipal sewer system. The applicant, Chris Cullen, presented the proposal for a two-bedroom, one-and-a-half-bath patio home featuring a four-season porch and a garage, emphasizing the use of energy-efficient SIP (Structural Insulated Panel) technology and the demand for affordable, one-level living options in the area.
The staff report highlighted that the property had been subdivided in 1963, predating current land use ordinances, and noted that the proposed structure met setback requirements. A previous similar variance had expired after six months due to inaction. The staff recommended approval, citing alignment with current development criteria. In the commission’s deliberation, they established that strict interpretation of the ordinance was impractical due to the lot’s size, and the deviation maintained the spirit and intent of the regulations. The land use was permitted in the R3 zoning district, and the variance would not alter the locality’s character. The commission approved the variance, stressing that any changes to the construction plans must be re-evaluated by the commission.
The second variance application, V24011, for Greg Brendam, requested a reduction in the minimum lot width from 75 feet to 65.3 feet. The property, also zoned R3, did not qualify for an over-the-counter residential unit allowance due to its non-conforming width. The staff report confirmed compliance with other performance standards and setbacks, recommending approval of the request. Greg Brenmule, the applicant, expressed his desire to build a two-story home, noting community support and his personal connection to the area. However, neighboring property owner Anthony Soer opposed the variance, arguing that it would set a troubling precedent and negatively impact his living space due to the proximity of the proposed house and driveway.
The commission discussed drainage concerns, with suggestions for implementing a rain garden or swale to manage runoff effectively. They emphasized ensuring all runoff would be contained on the applicant’s property. Ultimately, the commission approved the variance with stipulations to maintain the current impervious coverage plan and manage stormwater runoff on-site, passing the motion with a vote of three in favor and two against.
Another topic was the conditional use permit application for a fence around a community garden, part of the new City Hall Park. The proposed eight-foot fence exceeded the standard height limit of 72 inches, necessitating special approval. The commission discussed various aspects of the project, including the fence’s dimensions, materials, and the necessity of a survey to determine boundaries. Joe, the Public Works supervisor, and Gail Arie, chair of the park and recreation board, emphasized the need for the eight-foot fence to protect against deer, citing past issues with six-foot barriers.
Community input was solicited, with one resident offering to sell vacant lots to the city for the garden project. Arie detailed the garden plans, which include handicap-accessible raised beds and pathways lined with wood chips. The commission deliberated on the conditional use application, finding that it met all necessary criteria without creating nuisances or impeding normal development. They approved the application with the stipulation that the fence not exceed eight feet.
