Amy Patel provided personal insight into their family’s need for the deck, describing the existing backyard as lacking in usability and posing safety concerns due to wildlife from nearby woods. The proposed deck design, which includes enclosed railings and a gate, aims to create a secure area for family activities. The deck would be constructed with composite decking, aluminum railings, and wood framing, and feature a partially covered roof to allow for year-round use. Ms. Patel assured the board that no trees would be removed for the construction, with the area beneath the deck remaining as grass.
Board members inquired about the deck’s specifics, including its height and materials. The covered section would stand at 14 feet above grade, and the deck surface itself would be 12 feet 8 inches high. The Patels also planned to incorporate lighting features such as recessed LED fixtures, a ceiling fan light combination, and warm yellow LED lighting for the stairs and under the rail.
Discussion also touched upon the responsibilities of the Homeowners Association (HOA) concerning stormwater management features previously approved by the planning board. The applicant confirmed their participation in the HOA, which helped address concerns regarding maintenance of these stormwater mechanisms. The board professionals expressed overall satisfaction with the applicant’s compliance, except for a specific condition requiring a plot plan grading plan, which they agreed to waive due to the assurance of no grade changes.
Planner John Chadwick provided testimony supporting the application, highlighting that the proposed deck would not negatively impact the neighborhood. He noted the significant distance from the nearest home and the presence of a grove of trees that would act as a natural buffer, minimizing the visual impact on neighbors. Chadwick addressed concerns about the deck, stating, “I don’t see that applies,” in reference to potential negative impacts.
Board members unanimously expressed support for the application, acknowledging the challenges presented by the irregular shape of the lot. After deliberation, the board voted unanimously to approve the variance, allowing the Patels to proceed with their deck construction.
In addition to the Patel application, the board addressed several other significant scheduling items. The St. Bernard application was adjourned to January 14, 2025, at the applicant’s request, while the Starbucks application at Bridgewater Realty 2 LLC was also postponed to the same date. Applications from 821 Bridgewater LLC and the Jewish Community Center were continued to November 12, 2024, along with the CX Towers application, which will be re-noticed for that date. The Belly Holdings LLC application was carried to December 10, 2024, as were the matters involving 1200 Route 22 land investors and 1200 Route 22 LLC.
