Chatham Board of Health to Enforce Penalties on Non-Compliant Short-Term Rentals
- Meeting Overview:
During the recent Chatham Board of Health meeting, the primary focus was on addressing violations of short-term rental regulations. Two properties, 98 Main Street and Warren Street, were found to be non-compliant with the town’s requirement to renew their rental registrations for the 2025 season. Despite previous registration for the 2024 season, both properties had failed to renew by the March 1, 2025, deadline and have continued to operate with active listings without responding to multiple outreach attempts.
The board discussed the ongoing non-compliance issues with these properties, emphasizing the repeated attempts to communicate with the owners through emails, certified and regular mail, and the rental management software portal. It was noted that the certified letters were returned unclaimed, while the regular mail did not return, leading to a legal assumption of receipt. Both properties were also found to have advertised occupancy levels exceeding those permitted, raising concerns about potential revenue gains through non-compliance.
As a result, the board unanimously decided to move forward with issuing violation notices and imposing daily penalties of $200 for each day of continued non-compliance, effective immediately following the meeting. The board expressed a willingness to adjust fines if the owners come forward with valid explanations or compliance measures, acknowledging the possibility of extraordinary circumstances.
