Chatham Planning Board Approves Transfer Station Site Plan, Discusses ADU Bylaw Amendments
- Meeting Overview:
In a recent meeting, the Chatham Planning Board approved a redevelopment plan for the town-owned transfer station, discussed amendments to the town’s accessory dwelling unit (ADU) bylaws, and considered changes to site access on Bobby’s Lane. The board’s decisions and discussions focused on improving infrastructure, accommodating community housing needs, and ensuring compliance with existing regulations.
The most notable item on the agenda was the approval of the redevelopment plan for the transfer station on Sam Ryder Road. The applicant presented revisions to the site layout, which included relocating the license plate reader closer to the entrance, expanding the swap shop area to 17 parking spaces, and enhancing pedestrian safety with additional signage and a designated walkway. The board expressed appreciation for the applicant’s responsiveness to previous feedback, particularly the “amount of positive changes” implemented in a short period, as noted by one member. The plan also featured cost-saving measures such as reducing employee parking while maintaining adequate spaces for users, and the removal of a proposed shade tree. Concerns were raised about the functionality of the license plate reader system and management of the swap shop, with members questioning potential misuse of the area and seeking input from shop operators. Despite these concerns, the plan received unanimous approval with conditions including site plan certification and exterior lighting requirements.
Another discussion centered on proposed amendments to the zoning bylaws regarding ADUs, aligning them with the updated state law following the Affordable Homes Act of 2024. The proposed changes aim to replace existing definitions and regulations, allowing ADUs to be detached, attached, or internal to the principal dwelling. The amendments address the need for diverse housing options, emphasizing the importance of economically and energy-efficient units for workforce and year-round housing. The new regulations stipulate that ADUs must have a separate entrance, adhere to local dimensional and parking requirements, and be rented on a year-round basis to combat short-term rental issues. The board emphasized that the town could impose reasonable restrictions but could not require owner occupancy or impose limits on the number of ADUs. Concerns were expressed about potential challenges to the bylaw from the attorney general’s office, but the board decided against introducing special permitting for additional ADUs to maintain consistency with previous regulations. Public comments highlighted the lengthy approval process for ADUs, with residents urging the board to simplify the bylaw to encourage housing development.
The board also revisited access issues on Bobby’s Lane, where an applicant proposed changing the access point for a lot from Bobby’s Lane to Forest Beach Road. The board reiterated that access from Forest Beach Road had been previously rejected due to safety concerns and lack of access rights. Members emphasized the need for improvements to Bobby’s Lane and Pierce Path, with ongoing issues since prior applications. The applicant’s proposal was met with skepticism, as board members highlighted deficiencies related to Forest Beach Road, including site distance issues and obstructions. The applicant argued for the necessity of a driveway from Forest Beach Road, maintaining that they were not proposing to eliminate improvements to existing roads. However, the board remained firm in their stance.
