Chatham Zoning Board Approves Housing Proposal Amid Neighborhood Concerns

The modifications included a slight increase in building coverage from 11.2% to 11.4% and changes to the building dimensions to reduce overall height and improve neighborhood compatibility. These included reducing the basement and first floor size and lowering the total height from 28.85 feet to 26.6 feet.
Riley and architect Chris Cannon presented visual materials, such as drone footage, to argue that the design would harmonize with the neighborhood’s eclectic architectural styles. However, neighboring residents, particularly the Marino family, voiced concerns regarding the obstruction of views and alterations to the neighborhood’s character. Ross Marino highlighted how the proposed structure, at nearly 29 feet tall, would be closer to his property than a previous case, potentially obstructing sunlight and diminishing property value.
Despite these concerns, the board members deliberated on the merits of the proposal. They examined the impact of the changes, including the installation of a driveway drain to manage stormwater runoff, which was seen as a neighborhood improvement. The board acknowledged the Marino family’s opposition but ultimately concluded that the modifications to the application, such as the reduction in ridge height, addressed the main concerns. A motion to approve the application was made with conditions restricting construction activity during peak summer months to mitigate disruption.
In addition to the 48 CUS Lane proposal, the board addressed several other applications involving minor construction variances. Attorney Michael Ford represented Missy Abby LLC in seeking a modification for a swimming pool setback on Absigami Run, which had been installed slightly closer to the road than initially approved. The board recognized the uniqueness of the lot’s shape and deemed the variance error “dimminous,” thus approving it with conditions to maintain privacy and minimize disruption.
Another variance request involved a property on Old Mill Road, where a deck had been constructed a foot into the setback area. The discussion referenced a legal shift due to the Dedric case, which necessitated a variance instead of a special permit for such deviations. The board noted the minimal impact of the deck on the neighborhood due to its low profile and dense surrounding vegetation. Despite some dissent regarding the homeowner’s hiring practices, the board approved the variance, citing the greater hardship of reconstructing the deck.
The meeting concluded with a proposal concerning a retaining wall adjustment to preserve mature trees, which was unanimously supported by the board. The environmental benefits of saving the trees were emphasized, and conditions were imposed to ensure minimal disturbance during construction.
