Chatham Zoning Board Approves Key Variance for Historic Property Renovation

To expedite the process, they opted for a variance application that would allow local oversight without state intervention, adopting conditions similar to those of the historic preservation restriction.
Board members engaged in a discussion about the implications of the variance, particularly concerning the property’s historic status and the unique lot shape, which had been a topic of previous town meetings. Questions were raised about whether the variance application necessitated amendments to the existing bylaw to clarify the distinctions between local and state approvals.
No public opposition was recorded, and the board reviewed input from various town departments, including the Board of Health and the Conservation Commission, both of which expressed no concerns. The Chatham Historic Commission recognized the property’s historical significance but did not enforce a demolition delay. The board ultimately voted in favor of the variance, noting that it met the necessary criteria and would not substantially harm the public good or derogate from the bylaw’s intent.
In another development, the board approved an application by CBI Owner LLC to demolish and replace Bay View Cottage, a non-conforming structure due to its proximity to the road. The new design, which adheres to all setback requirements, promises to enhance visual appeal by being less visible from the road, thus addressing concerns from neighboring property owners about construction timing. The new structure will maintain the same building coverage and include two stories with two units, and a mechanical bunker as part of the development.
Additionally, the board considered an application on Florence Drive, where the Messiers proposed demolishing an existing house to build a new structure that would maximize lot coverage while remaining below the allowable limit. Although the proposed design aimed to address drainage issues and fit within the size range of neighborhood homes, concerns arose about its height compared to the predominantly single-story and one-and-a-half-story homes in the area. After discussing the potential impact on neighborhood aesthetics, the board opted for a continuance to allow for revisions to the design.
The meeting covered several other applications, including the conversion of a garage into living space on Thompson’s Trace and the installation of a generator on Shore Road, both of which received unanimous approval. These decisions reflect the board’s ongoing efforts to accommodate residential needs while respecting zoning regulations and community standards.
